AN ACT relating to the Nevada highway patrol; requiring the department of personnel to calculate the average salaries of certain law enforcement personnel; requiring that the proposed budget of the department of motor vehicles and public safety include salaries for officers of the Nevada highway patrol which are based on those calculations; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 284 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. The director shall calculate the respective average salaries as of

1-4 July 1 of each even-numbered year of all police officers of equivalent

1-5 rank employed by:

1-6 (a) Law enforcement agencies of cities whose population is 50,000 or

1-7 more;

1-8 (b) Law enforcement agencies of counties whose population is

1-9 100,000 or more; and

1-10 (c) Metropolitan police departments formed pursuant to chapter 280

1-11 of NRS in counties whose population is 100,000 or more.

1-12 2. The director shall forward the figures of the average salaries

1-13 calculated pursuant to this section to the chief of the budget division of

1-14 the department of administration and the director of the department of

1-15 motor vehicles and public safety not later than July 15 of each even-

1-16 numbered year.

2-1 Sec. 2. Chapter 353 of NRS is hereby amended by adding thereto a

2-2 new section to read as follows:

2-3 1. In preparing its proposed biennial budget, the department of

2-4 motor vehicles and public safety shall set the respective salaries of the

2-5 officers of the Nevada highway patrol at amounts which:

2-6 (a) For the first year of the biennium, are equal to or greater than the

2-7 average salary of police officers of equivalent rank as calculated by the

2-8 director of the department of personnel pursuant to section 1 of this act;

2-9 and

2-10 (b) For the second year of the biennium, are equal to the respective

2-11 amounts proposed pursuant to paragraph (a), plus an adjustment for

2-12 inflation, if any. The amount of the adjustments must be determined by

2-13 multiplying the respective amounts proposed pursuant to paragraph (a)

2-14 by the percentage of inflation, if any. The Consumer Price Index

2-15 published by the United States Department of Labor for July preceding

2-16 each biennium must be used to determine the percentage of inflation.

2-17 2. In preparing the proposed executive budget, the chief shall ensure

2-18 that the salaries of the officers of the Nevada highway patrol, as included

2-19 in the proposed budget of the department of motor vehicles and public

2-20 safety, are established in accordance with the provisions of subsection 1.

2-21 Sec. 3. NRS 353.150 is hereby amended to read as follows:

2-22 353.150 NRS 353.150 to 353.246, inclusive, and section 2 of this act

2-23 may be cited as the State Budget Act.

2-24 Sec. 4. Not later than 10 days after the effective date of this act, the

2-25 director of the department of personnel shall:

2-26 1. Calculate the average salaries paid to police officers as of July 1,

2-27 1998, pursuant to section 1 of this act; and

2-28 2. Forward the figures of the average salaries calculated pursuant to

2-29 subsection 1 to:

2-30 (a) The chairman of the senate standing committee on finance;

2-31 (b) The chairman of the assembly standing committee on ways and

2-32 means; and

2-33 (c) The fiscal analysis division of the legislative counsel bureau.

2-34 Sec. 5. This act becomes effective upon passage and approval.
