AN ACT relating to dentistry; authorizing the board of dental examiners of Nevada to issue a limited number of licenses each year to dentists licensed in other jurisdictions; establishing the fee for an application for a license to practice dentistry without examination; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 631 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. Except as otherwise provided in subsection 2, the board may,

1-4 without examination, issue a license to practice dentistry to a person

1-5 who:

1-6 (a) Holds a license to practice dentistry in another state, a territory or

1-7 possession of the United States or the District of Columbia whose

1-8 requirements for licensing at the time the license was issued are deemed

1-9 by the board to be substantially equivalent to the requirements for a

1-10 license to practice dentistry set forth in this chapter;

1-11 (b) Pays the fee prescribed by NRS 631.345; and

1-12 (c) Submits the statement required by NRS 631.225.

1-13 2. The board shall not issue a license pursuant to this section to:

1-14 (a) More than 20 persons each year;

1-15 (b) An applicant who has been refused a license in this state, another

1-16 state, a possession or territory of the United States or the District of

1-17 Columbia; or

2-1 (c) An applicant whose license to practice dentistry has been revoked

2-2 in this state, another state, a possession or territory of the United States

2-3 or the District of Columbia.

2-4 3. The board shall adopt regulations that prescribe the procedure for

2-5 the allocation of licenses issued pursuant to this section.

2-6 Sec. 2. NRS 631.240 is hereby amended to read as follows:

2-7 631.240 Except as otherwise provided in section 1 of this act:

2-8 1. [Any person desiring to obtain] Each applicant for a license to

2-9 practice dentistry in this state, after having complied with the regulations of

2-10 the board to determine eligibility, must:

2-11 (a) Present to the board a certificate granted by the National Board of

2-12 Dental Examiners which contains a notation that he has passed the board’s

2-13 examination with an average score of at least 75; and

2-14 (b) Be examined by the board on his practical knowledge of dentistry.

2-15 2. The board shall examine each applicant in writing on the contents

2-16 and interpretation of chapter 631 of NRS and the regulations of the board.

2-17 3. The examination must include clinical demonstrations of the

2-18 applicant’s skill in dentistry.

2-19 4. All persons who present the appropriate certificate and successfully

2-20 complete the examination must be registered as licensed dentists on the

2-21 board register, as provided in this chapter, and are entitled to receive a

2-22 certificate of registration, signed by the member of the board who is a

2-23 representative of the general public and those members of the board who

2-24 are dentists.

2-25 Sec. 3. NRS 631.345 is hereby amended to read as follows:

2-26 631.345 1. The fees which must be charged by the board for the

2-27 performance of the duties imposed upon it by this chapter are as follows:

2-28 Examination fee for license to practice dentistry $300

2-29 Examination fee for license to practice dental hygiene 150

2-30 Application fee for a specialist license 125

2-31 Application fee for a license to practice dentistry without

2-32 examination 150

2-33 Application and examination fee for permit to administer

2-34 general anesthesia or sedation. 200

2-35 Annual renewal fee for permit to administer general

2-36 anesthesia or sedation 50

2-37 Annual license renewal fee for a general dentist or specialist,

2-38 not to exceed 300

2-39 Annual license renewal fee for a dental hygienist, not to

2-40 exceed 150

2-41 Annual license renewal fee for an inactive dentist 100

2-42 Annual license renewal fee for a retired or disabled dentist 25

3-1 Annual license renewal fee for an inactive dental hygienist $25

3-2 Annual license renewal fee for a retired or disabled dental

3-3 hygienist 25

3-4 Reinstatement fee for a suspended license to practice dentistry

3-5 or dental hygiene, not to exceed 200

3-6 Reinstatement fee for a revoked license to practice dentistry or

3-7 dental hygiene 500

3-8 2. Except as otherwise provided in this subsection, the board shall

3-9 charge a fee to review a course of continuing education for accreditation.

3-10 The fee must not exceed $150 per credit hour of the proposed course. The

3-11 board shall not charge a nonprofit organization or an agency of the state or

3-12 of a political subdivision of the state a fee to review a course of continuing

3-13 education.

3-14 3. All fees prescribed in this section are payable in advance and must

3-15 not be refunded.

3-16 Sec. 4. Section 1 of this act is hereby amended to read as follows:

3-17 Section 1. 1. Except as otherwise provided in subsection 2,

3-19 dentistry to a person who:

3-20 (a) Holds a license to practice dentistry in another state, a

3-21 territory or possession of the United States or the District of

3-28 2. The board shall not issue a license pursuant to this section to:

3-31 another state, a possession or territory of the United States or the

3-33 (c) An applicant whose license to practice dentistry has been

3-34 revoked in this state, another state, a possession or territory of the

3-35 United States or the District of Columbia.

3-36 3. The board shall adopt regulations that prescribe the

3-37 procedure for the allocation of licenses issued pursuant to this

3-38 section.

3-39 Sec. 5. 1. This section and sections 1, 2 and 3 of this act become

3-40 effective on October 1, 1999.

4-1 2. Section 4 of this act becomes effective on the date on which the

4-2 provisions of 42 U.S.C. § 666 requiring each state to establish procedures

4-3 under which the state has authority to withhold or suspend, or to restrict the

4-4 use of professional, occupational and recreational licenses of persons who:

4-5 (a) Have failed to comply with a subpoena or warrant relating to a

4-6 procedure to determine the paternity of a child or to establish or enforce an

4-7 obligation for the support of a child; or

4-8 (b) Are in arrears in the payment for the support of one or more

4-9 children,

4-10 are repealed by the Congress of the United States.
