AN ACT relating to trade regulation; prohibiting the refusal to sell fireworks to certain persons; providing a penalty; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 597 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. A wholesale dealer of fireworks shall not refuse to sell fireworks to

1-4 a buyer if the buyer can satisfactorily demonstrate that:

1-5 (a) He has conformed to all applicable federal, state and local laws

1-6 relating to the purchase, sale, use, storage and possession of such

1-7 fireworks; and

1-8 (b) He has the financial capability to pay for the fireworks with cash, a

1-9 cash equivalent or credit.

1-10 2. A person who violates this section is guilty of a misdemeanor.

1-11 Sec. 2. NRS 244.367 is hereby amended to read as follows:

1-12 244.367 The board of county commissioners shall have power and

1-13 jurisdiction in their respective counties to pass ordinances prohibiting,

1-14 restricting, suppressing or otherwise regulating the sale, use, storage and

1-15 possession of fireworks, and providing penalties for the violation thereof.

1-16 Such an ordinance must not be inconsistent with section 1 of this act.

1-17 Sec. 3. This act becomes effective upon passage and approval.
