AN ACT relating to state parks; requiring the administrator of the division of state parks of the state department of conservation and natural resources to charge and collect a fee from each person who rides a motorcycle or bicycle into a state park; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 407 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. The administrator shall charge and collect a fee of $5 per day

1-4 from each person who rides a motorcycle or bicycle into a state park.

1-5 2. Except as otherwise provided in NRS 407.0762, the fees collected

1-6 pursuant to this section must be deposited in the state general fund.

1-7 Sec. 2. NRS 407.0762 is hereby amended to read as follows:

1-8 407.0762 1. The account for maintenance of state parks within the

1-9 division of state parks is hereby created in the state general fund. Except as

1-10 otherwise provided in NRS 407.0765, any amount of fees collected

1-11 pursuant to subsection 4 of NRS 407.065 and section 1 of this act in a

1-12 calendar year, [which is in excess of] that exceeds the amounts authorized

1-13 for expenditure from [that revenue source] those sources of revenue in the

1-14 [division’s] budget of the division for the fiscal year beginning in that

1-15 calendar year, must be deposited in the account. The interest and income

1-16 earned on the money in the account, after deducting any applicable charges,

1-17 must be credited to the account.

2-1 2. The money in the account does not lapse to the state general fund at

2-2 the end of any fiscal year.

2-3 3. The money deposited in the account pursuant to subsection 1 must

2-4 only be used to repair and maintain state parks, monuments and

2-5 recreational areas.

2-6 4. Before the administrator may expend money pursuant to subsection

2-7 3:

2-8 (a) For emergency repairs, he must [first] receive the approval of the

2-9 director.

2-10 (b) For purposes other than emergency repairs, he must [first] receive

2-11 the approval of the director and of the interim finance committee.
