AN ACT relating to fireworks; requiring a license or permit that may be required for the sale of fireworks to be issued by the licensing authority of a city or county; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 244.367 is hereby amended to read as follows:

1-2 244.367 1. The board of county commissioners shall have power and

1-3 jurisdiction in their respective counties to pass ordinances prohibiting,

1-4 restricting, suppressing or otherwise regulating the sale, use, storage and

1-5 possession of fireworks, and providing penalties for the violation thereof.

1-6 2. An ordinance passed pursuant to subsection 1 must provide that

1-7 any license or permit that may be required for the sale of fireworks must

1-8 be issued by the licensing authority for:

1-9 (a) The county, if the fireworks are sold within the unincorporated

1-10 areas of the county; or

1-11 (b) A city located within the county, if the fireworks are sold within the

1-12 jurisdiction of that city.

1-13 Sec. 2. This act becomes effective upon passage and approval.
