AN ACT relating to license plates; providing for the manufacturing of certain license plates under certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 482.266 is hereby amended to read as follows:

1-2 482.266 1. [At the request of a person who applies for the

1-3 registration or renewal of the registration of a vehicle that has motor

1-4 vehicle license plates which were issued before January 1, 1982, the

1-5 department shall refurbish the license plates for a fee not to exceed the

1-6 actual cost of the refurbishment.

1-7 2. If a motor vehicle license plate that was issued before January 1,

1-8 1982, is delivered to the department for refurbishment, the person who

1-9 applies for the registration or renewal of registration of the vehicle shall

1-10 display on the vehicle a temporary permit which must be affixed to the

1-11 vehicle in a form, manner and position determined by the department.] A

1-12 person who desires to have regular or personalized license plates that are

1-13 substantially in the same color and form as license plates manufactured

1-14 before January 1, 1982, must:

1-15 (a) Submit a written request for such license plates to the department

1-16 in a manner and form prescribed by the department; and

2-1 (b) In addition to all other applicable registration fees, licensing fees

2-2 and motor vehicle privilege taxes, pay the manufacturing fee prescribed

2-3 by the department.

2-4 A person requesting license plates pursuant to this section must comply

2-5 with all requirements for registration and licensing pursuant to this

2-6 chapter. A request for license plates pursuant to this section does not, by

2-7 itself, constitute a request for special license plates pursuant to

2-8 subsection 3 of NRS 482.265.

2-9 2. After receiving a request and the full amount of the payment due

2-10 for license plates requested pursuant to subsection 1, the department

2-11 shall manufacture the license plates using substantially the same process,

2-12 dies and materials as were used to manufacture license plates before

2-13 January 1, 1982. The department shall deliver license plates requested

2-14 pursuant to this section to a person who requests such license plates

2-15 within 180 days after acceptance of the written request or after receipt of

2-16 payment therefor, whichever occurs last.

2-17 3. The department shall:

2-18 (a) Prescribe, by regulation, a manner and form for submitting a

2-19 written request pursuant to subsection 1. The form must include, without

2-20 limitation, an indication of whether the requester desires to have the

2-21 same letters and numbers on the license plates requested as are on the

2-22 license plates that are registered to him at the time of the request.

2-23 (b) Determine the cost of manufacturing a license plate pursuant to

2-24 this section and prescribe a manufacturing fee, which must not exceed

2-25 $25, to defray the cost of manufacturing license plates pursuant to this

2-26 section. The manufacturing fee must be:

2-27 (1) Collected by the department;

2-28 (2) Deposited with the state treasurer to the credit of the motor

2-29 vehicle fund; and

2-30 (3) Allocated to the department to defray the costs of

2-31 manufacturing license plates pursuant to this section.

2-32 4. A person who requests license plates pursuant to this section may

2-33 keep the license plates which are registered to him at the time of the

2-34 request if the license plates requested contain the same letters and

2-35 numbers as the license plates which are registered to him at the time of

2-36 the request.

2-37 Sec. 2. Section 4 of chapter 422, Statutes of Nevada 1997, at page

2-38 1503, is hereby amended to read as follows:

2-39 Sec. 4. 1. This section and section 3 of this act become

2-40 effective on October 1, 1997.

2-41 2. Section 2 of this act becomes effective at 12:02 a.m. on

2-42 October 1, 1997.

3-1 3. Section 1 of this act becomes effective on [January 1, 2001.]

3-2 October 1, 1999.

3-3 Sec. 3. This act becomes effective at 12:01 a.m. on October 1, 1999.
