AN ACT relating to vehicles; revising provisions governing the removal and disposition of abandoned vehicles; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 487.210 is hereby amended to read as follows:

1-2 487.210 As used in NRS 487.220 to 487.300, inclusive, unless the

1-3 context otherwise requires, "abandoned vehicle" means [any vehicle which]

1-4 a vehicle:

1-5 1. That the owner has discarded [.] ; or

1-6 2. Which has not been reclaimed by the registered owner or a person

1-7 having a security interest in the vehicle within 15 days after notification

1-8 pursuant to NRS 487.250.

1-9 Sec. 2. NRS 487.260 is hereby amended to read as follows:

1-10 487.260 1. If the vehicle is appraised at a value of more than $500

1-11 the state agency or political subdivision shall dispose of it as provided in

1-12 NRS 487.270.

1-13 2. If the vehicle is appraised as a junk vehicle, the department may

1-14 issue a junk certificate to the automobile wrecker or tow operator who

1-15 removed the vehicle.

1-16 3. An automobile wrecker who possesses a junk certificate for a junk

1-17 vehicle may dismantle, scrap, crush or otherwise destroy the vehicle.

1-18 4. A vehicle for which a junk certificate has been issued may be sold to

1-19 an automobile wrecker by the person to whom the junk certificate was

1-20 issued by the seller’s endorsement on the certificate. An automobile

2-1 wrecker who purchases a vehicle for which a junk certificate has been

2-2 issued shall, within 10 days after purchase, apply to the department for a

2-3 new junk certificate and surrender the original certificate.

2-4 5. A person who sells, dismantles, scraps, crushes or otherwise

2-5 destroys a junk vehicle shall maintain, for at least 2 years, a copy of the

2-6 junk certificate and a record of the name and address of the person from

2-7 whom the vehicle was acquired and the date thereof. He shall allow any

2-8 peace officer or any investigator employed by a state agency to inspect the

2-9 records during business hours.

2-10 6. As used in this section, "junk vehicle" means a vehicle, including

2-11 component parts, which:

2-12 (a) Has been discarded or abandoned;

2-13 (b) Has been ruined, wrecked, dismantled or rendered inoperative;

2-14 (c) Is unfit for further use in accordance with the original purpose for

2-15 which it was constructed;

2-16 (d) Is not registered with the department [;] or has not been reclaimed

2-17 by the registered owner or a person having a security interest in the

2-18 vehicle within 15 days after notification pursuant to NRS 487.250; and

2-19 (e) Has value principally as scrap which does not exceed $200.
