AN ACT relating to holidays; changing the legal holiday for the observance of Nevada Day; removing the exception that allows schools to remain open on Nevada Day; revising the provision governing the transaction of banking business on holidays and weekends; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 236.015 is hereby amended to read as follows:

1-2 236.015 1. The following days are declared to be legal holidays for

1-3 state, county and city governmental offices:

1-4 January 1 (New Year’s Day)

1-5 [Third] Martin Luther King, Jr.’s birthday is on January 15 but is to

1-6 be observed on the third Monday in January [(Martin Luther King,

1-7 Jr.’s Birthday)

1-8 Third] Washington’s birthday is on February 22 but is to be

1-9 observed on the third Monday in February [(Washington’s

1-10 Birthday)]

1-11 Last Monday in May (Memorial Day)

1-12 July 4 (Independence Day)

1-13 First Monday in September (Labor Day)

1-14 Nevada Day is October 31 [(Nevada Day)] but is to be observed on

1-15 the last Friday in October

1-16 November 11 (Veterans’ Day)

2-1 Fourth Thursday in November (Thanksgiving Day)

2-2 Friday following the fourth Thursday in November (Family Day)

2-3 December 25 (Christmas Day)

2-4 Any day that may be appointed by the President of the United States

2-5 for public fast, thanksgiving or as a legal holiday except for any

2-6 Presidential appointment of the fourth Monday in October as

2-7 Veterans’ Day.

2-8 2. Except as otherwise provided by NRS 293.560 and 293C.527, all

2-9 state, county and city offices, courts, public schools and the University and

2-10 Community College System of Nevada must close on the legal holidays

2-11 enumerated in subsection 1 unless in the case of appointed holidays all or a

2-12 part thereof are specifically exempted.

2-13 3. If January 1, July 4, [October 31,] November 11 or December 25

2-14 falls upon a:

2-15 (a) Sunday, the Monday following must be observed as a legal holiday.

2-16 (b) Saturday, the Friday preceding must be observed as a legal holiday.

2-17 Sec. 2. NRS 293.560 is hereby amended to read as follows:

2-18 293.560 1. Except as otherwise provided in NRS 293.502,

2-19 registration must close at 9 p.m. on the fifth Saturday preceding any

2-20 primary or general election and at 9 p.m. on the third Saturday preceding

2-21 any recall or special election, except that if a recall or special election is

2-22 held on the same day as a primary or general election, registration must

2-23 close at 9 p.m. on the fifth Saturday preceding the day of the elections.

2-24 2. The offices of the county clerk and other ex officio registrars must

2-25 be open from 9 a.m. to 5 p.m. and the office of the county clerk must also

2-26 be open from 7 p.m. to 9 p.m., including Saturdays, during the last days

2-27 before the close of registration, according to the following schedule:

2-28 (a) In a county whose population is less than 100,000, those offices must

2-29 be open during the last 3 days before registration closes.

2-30 (b) In all other counties, those offices must be open during the last 5

2-31 days before registration closes.

2-32 3. Except for a special election held pursuant to chapter 306 or 350 of

2-33 NRS:

2-34 (a) The county clerk of each county shall cause a notice signed by him

2-35 to be published in a newspaper having a general circulation in the county

2-36 indicating the day that registration will be closed. If no such newspaper is

2-37 published in the county, the publication may be made in a newspaper of

2-38 general circulation published in the nearest county in this state.

2-39 (b) The notice must be published once each week for 4 consecutive

2-40 weeks next preceding the close of registration for any election.

3-1 4. The offices of the county clerk and other ex officio registrars may

3-2 remain open on the last Friday in October [31] in each even-numbered

3-3 year.

3-4 Sec. 3. NRS 388.110 is hereby amended to read as follows:

3-5 388.110 No school may be kept open on any day declared to be a legal

3-6 holiday pursuant to NRS 236.015 . [except that any board of trustees of a

3-7 school district may elect to keep school open on October 31 (or other day

3-8 observed as Nevada Day) and observe such holiday with appropriate

3-9 exercises.]

3-10 Sec. 4. NRS 662.255 is hereby amended to read as follows:

3-11 662.255 1. A bank may elect to close on Saturdays, Sundays or legal

3-12 holidays. Except as otherwise provided in subsection 2 and NRS 104.4303,

3-13 if a bank elects not to close on a Saturday, Sunday or legal holiday, all

3-14 business transacted on a Saturday, Sunday or legal holiday shall be deemed

3-15 to have been transacted on the next banking day that is not a Saturday,

3-16 Sunday or legal holiday.

3-17 2. If a bank elects not to close on a Saturday, Sunday or legal

3-18 holiday which falls on the last day of a calendar year, that day shall be

3-19 deemed a regular banking day for the purposes of transacting business.

3-20 3. As used in this section, the term "legal holiday" includes all days

3-21 which are declared by NRS 236.015 to be legal holidays.

3-22 Sec. 5. 1. This section and section 4 of this act become effective on

3-23 October 1, 1999.

3-24 2. Sections 1, 2 and 3 of this act become effective on January 1, 2000.
