AN ACT relating to traffic laws; providing for the exclusive use of certain parking spaces designated for the handicapped by certain vehicles; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 484.408 is hereby amended to read as follows:

1-2 484.408 1. Any parking space designated for the handicapped must

1-3 be indicated by a sign:

1-4 (a) Bearing the international symbol of access with or without the words

1-5 "Parking," "Handicapped Parking," "Handicapped Parking Only," or

1-6 "Reserved for the Handicapped," or any other word or combination of

1-7 words indicating that the space is designated for the handicapped;

1-8 (b) Stating "Minimum fine of $100 for use by others" or equivalent

1-9 words; and

1-10 (c) The bottom of which must be not less than 4 feet above the ground.

1-11 2. In addition to the requirements of subsection 1, a parking space

1-12 designated for the handicapped that is designed for the exclusive use of a

1-13 vehicle with a side-loading wheelchair lift must be indicated by a sign

1-14 using a combination of words to state that the space is for the exclusive

1-15 use of a vehicle with a side-loading wheelchair lift.

1-16 3. A person shall not park a vehicle in a space designated for the

1-17 handicapped by a sign that meets the requirements of subsection 1, whether

1-18 on public or privately owned property, unless he is eligible to do so and the

1-19 vehicle displays:

1-20 (a) Special license plates issued pursuant to NRS 482.384;

2-1 (b) A special or temporary parking placard issued pursuant to NRS

2-2 482.384;

2-3 (c) Special license plates or a special or temporary parking placard

2-4 displaying the international symbol of access issued by another state or a

2-5 foreign country; or

2-6 (d) Special license plates for a disabled veteran and a special parking

2-7 placard issued pursuant to NRS 482.384.

2-8 [3.] 4. A person shall not park a vehicle in a space designated for the

2-9 handicapped by a sign that meets the requirements of subsection 2,

2-10 whether on public or privately owned property, unless:

2-11 (a) He is eligible to do so;

2-12 (b) The vehicle displays the special license plates or placard set forth

2-13 in subsection 3; and

2-14 (c) The vehicle is equipped with a side-loading wheelchair lift.

2-15 5. A person shall not use [such] a plate or placard [for a vehicle] set

2-16 forth in subsection 3 to park in a space designated for the handicapped

2-17 unless he is a person with a disability which limits or impairs the ability to

2-18 walk, a disabled veteran or the driver of a vehicle in which such a person is

2-19 a passenger.

2-20 [4.] 6. Any person who violates any provision of this section shall be

2-21 punished:

2-22 (a) Upon the first offense by a fine of $100.

2-23 (b) Upon the second offense by a fine of $250.

2-24 (c) Upon the third or subsequent offense by a fine of not less than $500

2-25 nor more than $1,000.
