THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 482 of NRS is hereby amended by adding thereto a1-2
new section to read as follows:1-3
1. Except as otherwise provided in this subsection, the department, in1-4
cooperation with the division of agriculture of the department of business1-5
and industry and the Nevada Future Farmers of America Foundation,1-6
shall design, prepare and issue license plates which indicate support for1-7
the promotion of agriculture within this state, including, without1-8
limitation, support for the programs and activities of the Future Farmers1-9
of America within this state, using any colors that the department deems1-10
appropriate. The design of the license plates must include the phrase1-11
"People Grow Things Here!" and an identifying symbol furnished by the1-12
Nevada Future Farmers of America Foundation. The department shall1-13
not design, prepare or issue the license plates unless it receives at least1-14
250 applications for the issuance of those plates.1-15
2. If the department receives at least 250 applications for the1-16
issuance of license plates which indicate support for the promotion of2-1
agriculture within this state, the department shall issue those plates for a2-2
passenger car or light commercial vehicle upon application by a person2-3
who is entitled to license plates pursuant to NRS 482.265 and who2-4
otherwise complies with the requirements for registration and licensing2-5
pursuant to this chapter. A person may request that personalized prestige2-6
license plates issued pursuant to NRS 482.3667 be combined with license2-7
plates which indicate support for the promotion of agriculture within this2-8
state if that person pays the fees for the personalized prestige license2-9
plates in addition to the fees for the license plates which indicate support2-10
for the promotion of agriculture within this state pursuant to subsections2-11
3 and 4.2-12
3. The fee for license plates which indicate support for the promotion2-13
of agriculture within this state is $35, in addition to all other applicable2-14
registration and license fees and motor vehicle privilege taxes. The2-15
license plates are renewable upon the payment of $10.2-16
4. In addition to all fees for the license, registration and privilege2-17
taxes, a person who requests a set of license plates which indicate support2-18
for the promotion of agriculture within this state must pay for the initial2-19
issuance of the plates an additional fee of $25 and for each renewal of2-20
the plates an additional fee of $20, to be distributed in accordance with2-21
subsection 5.2-22
5. The department shall deposit the fees collected pursuant to2-23
subsection 4 with the state treasurer for credit to the state general fund.2-24
The state treasurer shall, on a quarterly basis, distribute the fees2-25
deposited pursuant to this section in the following manner:2-26
(a) Remit one-half of the fees to the Nevada Future Farmers of2-27
America Foundation for the support of programs and activities of the2-28
Future Farmers of America within this state.2-29
(b) Deposit one-half of the fees for credit to the account for license2-30
plates for the promotion of agriculture within this state created pursuant2-31
to section 4 of this act.2-32
6. If, during a registration year, the holder of license plates issued2-33
pursuant to the provisions of this section disposes of the vehicle to which2-34
the plates are affixed, he may retain the plates and:2-35
(a) Affix them to another vehicle that meets the requirements of this2-36
section if the transfer and registration fees are paid as set out in this2-37
chapter; or2-38
(b) Within 30 days after removing the plates from the vehicle, return2-39
them to the department.2-40
Sec. 2. NRS 482.216 is hereby amended to read as follows: 482.216 1. Upon the request of a new vehicle dealer, the department2-42
may authorize the new vehicle dealer to:3-1
(a) Accept applications for the registration of the new motor vehicles he3-2
sells and the related fees and taxes;3-3
(b) Issue certificates of registration to applicants who satisfy the3-4
requirements of this chapter; and3-5
(c) Accept applications for the transfer of registration pursuant to NRS3-6
482.399 if the applicant purchased from the new vehicle dealer a new3-7
vehicle to which the registration is to be transferred.3-8
2. A new vehicle dealer who is authorized to issue certificates of3-9
registration pursuant to subsection 1 shall:3-10
(a) Transmit the applications he receives to the department within the3-11
period prescribed by the department;3-12
(b) Transmit the fees he collects from the applicants and properly3-13
account for them within the period prescribed by the department;3-14
(c) Comply with the regulations adopted pursuant to subsection 4; and3-15
(d) Bear any cost of equipment which is necessary to issue certificates of3-16
registration, including any computer hardware or software.3-17
3. A new vehicle dealer who is authorized to issue certificates of3-18
registration pursuant to subsection 1 shall not:3-19
(a) Charge any additional fee for the performance of those services;3-20
(b) Receive compensation from the department for the performance of3-21
those services;3-22
(c) Accept applications for the renewal of registration of a motor3-23
vehicle; or3-24
(d) Accept an application for the registration of a motor vehicle if the3-25
applicant wishes to:3-26
(1) Obtain special license plates pursuant to NRS 482.3667 to3-27
482.3825, inclusive3-28
(2) Claim the exemption from the vehicle privilege tax provided3-29
pursuant to NRS 361.1565 to veterans and their relations.3-30
4. The director shall adopt such regulations as are necessary to carry3-31
out the provisions of this section. The regulations adopted pursuant to this3-32
subsection must provide for:3-33
(a) The expedient and secure issuance of license plates and decals by the3-34
department; and3-35
(b) The withdrawal of the authority granted to a new vehicle dealer3-36
pursuant to subsection 1 if that dealer fails to comply with the regulations3-37
adopted by the department. Sec. 3. NRS 482.500 is hereby amended to read as follows:3-39
482.500 1. Except as otherwise provided in subsection 2, whenever3-40
upon application any duplicate or substitute certificate of registration, decal3-41
or number plate is issued, the following fees must be paid:4-1
For a certificate of registration $5.004-2
For every substitute number plate or set of plates 5.004-3
For every duplicate number plate or set of plates 10.004-4
For every decal displaying a county name 504-5
For every other decal (license plate sticker or tab) 5.004-6
2. The following fees must be paid for any replacement plate or set of4-7
plates issued for the following special license plates:4-8
(a) For any special plate issued pursuant to NRS 482.3667, 482.3672,4-9
482.3675, 482.370 to 482.376, inclusive, or 482.379 to 482.3816,4-10
inclusive, and section 1 of this act, a fee of $10.4-11
(b) For any special plate issued pursuant to NRS 482.368, 482.3765,4-12
482.377 or 482.378, a fee of $5.4-13
(c) For any souvenir license plate issued pursuant to NRS 482.3825 or4-14
sample license plate issued pursuant to NRS 482.2703, a fee equal to that4-15
established by the director for the issuance of those plates.4-16
3. The fees which are paid for duplicate number plates and decals4-17
displaying county names must be deposited with the state treasurer for4-18
credit to the motor vehicle fund and allocated to the department to defray4-19
the costs of duplicating the plates and manufacturing the decals.4-20
4. As used in this section:4-21
(a) "Duplicate number plate" means a license plate or a set of license4-22
plates issued to a registered owner which repeat the code of a plate or set of4-23
plates previously issued to the owner to maintain his registration using the4-24
same code.4-25
(b) "Substitute number plate" means a license plate or a set of license4-26
plates issued in place of a previously issued and unexpired plate or set of4-27
plates. The plate or set of plates does not repeat the code of the previously4-28
issued plate or set.4-29
Sec. 4. Chapter 561 of NRS is hereby amended by adding thereto a4-30
new section to read as follows:4-31
1. The account for license plates for the promotion of agriculture4-32
within this state is hereby created in the state general fund. The4-33
administrator shall administer the account.4-34
2. The money in the account does not lapse to the state general fund4-35
at the end of a fiscal year. The interest and income earned on the money4-36
in the account, after deducting any applicable charges, must be credited4-37
to the account.4-38
3. The money in the account must be used only for the promotion of4-39
agriculture within this state and must not be used to replace or supplant4-40
money available from other sources. The administrator may provide4-41
grants from the account to other public agencies to carry out the4-42
provisions of this section.5-1
Sec. 5. The amendatory provisions of this act expire by limitation on5-2
October 1, 2003, if on that date the department of motor vehicles and5-3
public safety has received fewer than 250 applications for the issuance of a5-4
license plate pursuant to section 1 of this act.~
