THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 200 of NRS is hereby amended by adding thereto a1-2
new section to read as follows:1-3
1. Except as otherwise provided in subsection 2, it is unlawful for a1-4
person knowingly to photograph, videotape or otherwise film another1-5
person using a device that is purposely:1-6
(a) Concealed from the view of the person being photographed,1-7
videotaped or otherwise filmed; or1-8
(b) Disguised so as to avoid detection by the person being1-9
photographed, videotaped or otherwise filmed.1-10
2. Subsection 1 does not apply to a person who photographs,1-11
videotapes or otherwise films another person if:1-12
(a) The other person consents to the filming; or1-13
(b) The filming will be used exclusively:1-14
(1) To further a criminal investigation; or1-15
(2) For purposes of security or protection of persons or property.1-16
3. A person who violates the provisions of this section is guilty of a1-17
misdemeanor and shall be punished by a fine of not more than $500 per1-18
violation.2-1
Sec. 2. The amendatory provisions of this act do not apply to offenses2-2
that are committed before October 1, 1999.~
