AN ACT relating to hidden cameras; prohibiting the use of hidden cameras under certain circumstances; providing a penalty; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 200 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. Except as otherwise provided in subsection 2, it is unlawful for a

1-4 person knowingly to photograph, videotape or otherwise film another

1-5 person using a device that is purposely:

1-6 (a) Concealed from the view of the person being photographed,

1-7 videotaped or otherwise filmed; or

1-8 (b) Disguised so as to avoid detection by the person being

1-9 photographed, videotaped or otherwise filmed.

1-10 2. Subsection 1 does not apply to a person who photographs,

1-11 videotapes or otherwise films another person if:

1-12 (a) The other person consents to the filming; or

1-13 (b) The filming will be used exclusively:

1-14 (1) To further a criminal investigation; or

1-15 (2) For purposes of security or protection of persons or property.

1-16 3. A person who violates the provisions of this section is guilty of a

1-17 misdemeanor and shall be punished by a fine of not more than $500 per

1-18 violation.

2-1 Sec. 2. The amendatory provisions of this act do not apply to offenses

2-2 that are committed before October 1, 1999.
