SUMMARY—Authorizes possession, use, manufacture, purchase, installation, transportation or sale of chlorofluorocarbons. (BDR 40-1518)

EXPLANATION – Matter in

Whereas, The health, safety and welfare of the people of the State of
Nevada will be promoted by the continued use of chlorofluorocarbons for
purposes relating to refrigeration; and
Whereas, The use of chlorofluorocarbons for purposes relating to
refrigeration is more economical, less corrosive, more efficient and safer
than the use of currently available alternatives; and
Whereas, The continued use of chlorofluorocarbons to maintain
service equipment that was designed for the use of chlorofluorocarbons will
extend the operating life of equipment currently in use and cause the
equipment to operate more efficiently and safely; and
Whereas, Current concern about the danger of ozone holes is
scientifically unsupported; and
Whereas, Providing a monopoly for a new refrigerant will increase the
price of the refrigerant in the State of Nevada and cost the people of the
State of Nevada millions of dollars; now, therefore,
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 459 of NRS is hereby amended by adding thereto a2-2
new section to read as follows:2-3
1. Notwithstanding any other law, a person may possess, use,2-4
manufacture, purchase, install, transport or sell chlorofluorocarbons.2-5
2. The possession, use, manufacture, purchase, installation,2-6
transportation or sale of chlorofluorocarbons does not subject any2-7
person, this state or any political subdivision of this state to any penalty,2-8
fine, retaliatory action or other punitive measure.~
