CHAPTER........

AN ACT relating to vessels; revising the provisions governing the payment of storage fees for

certain vessels stored to preserve evidence of the commission of a crime; and

providing other matters properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 488.910 is hereby amended to read as follows:

  1. 488.910 1. If a peace officer has probable cause to believe that a
  1. vessel or its contents contain evidence tending to show that a criminal
  1. offense has been committed or that a particular person has committed an
  1. offense, the officer may take whatever steps are reasonable to ensure the
  1. preservation of [such] the evidence including safe storage of the vessel or
  1. its contents.
  1. 2. If a criminal conviction is obtained as a result of an action taken
  1. pursuant to subsection 1, the person convicted shall pay any storage fees
  1. incurred pursuant to that subsection. If a conviction is not obtained, the
  1. [division of wildlife of the state department of conservation and natural
  1. resources] law enforcement agency that seized the vessel pursuant to
  1. subsection 1 shall pay those fees.

Sec. 2. This act becomes effective upon passage and approval.
