1-1 Section 1. NRS 458.380 is hereby amended to read as follows:

1-2 458.380 1. The commission on substance abuse education,

1-14 of whom is a licensed employee of a local school district;

2-1 (c) Three members who [are managers of programs which are] represent

2-2 programs and organizations for the rehabilitation of persons who abuse

2-3 drugs and alcohol, at least one of whom is a manager of a program

2-4 accredited by the state to treat persons who abuse drugs and alcohol; and

2-5 (d) Four members who represent the general public.

2-6 3. At least three of the voting members of the commission must be

2-7 representatives of northern Nevada, three must be representatives of

2-8 southern Nevada and three must be representatives of rural Nevada.

2-9 4. The legislative commission shall appoint one member of the

2-10 senate and one member of the assembly to serve as nonvoting members

2-11 of the commission. Such members must be appointed with appropriate

2-12 regard for their experience with and knowledge of matters relating to

2-13 substance abuse education, prevention, enforcement and treatment.

2-14 5. The director of the department of human resources, the

2-15 superintendent of public instruction, the director of the department of

2-16 employment, training and rehabilitation, the director of the department of

2-17 prisons, the attorney general and the director of the department of motor

2-18 vehicles and public safety are ex officio nonvoting members of the

2-19 commission. An ex officio member may designate a representative to serve

2-20 in his place on the commission or to attend a meeting of the commission in

2-21 his place. Each ex officio member or his representative shall attend each

2-22 meeting of the commission and provide any information which the

2-23 commission requests.

2-24 [5.] 6. The term of office of each [appointed] voting member of the

2-25 commission is 2 years.

2-26 [6.] 7. The governor shall appoint one member who is not an elected

2-27 official to serve as chairman of the commission.

2-28 [7.] 8. Each member of the commission is entitled to receive the per

2-29 diem allowance and travel expenses provided for state officers and

2-30 employees generally.

2-31 9. Except during a regular or special session of the legislature, each

2-32 legislative member of the commission is entitled to receive the

2-33 compensation provided for a majority of the members of the legislature

2-34 during the first 60 days of the preceding regular session for each day or

2-35 portion of a day during which he attends a meeting of the commission or

2-36 is otherwise engaged in the business of the commission. The salaries and

2-37 expenses of the legislative members of the commission must be paid from

2-38 the legislative fund.

2-39 Sec. 2. NRS 458.390 is hereby amended to read as follows:

2-40 458.390 1. The commission shall meet at least quarterly or by a call

3-1 2. Seven voting members of the commission, including at least one

3-2 member who is a representative of southern Nevada, one member who is a

3-3 representative of northern Nevada and one member who is a representative

3-4 of rural Nevada, constitute a quorum.

3-5 3. A quorum may exercise all of the powers conferred on the

3-6 commission.

3-7 4. The chairman of the commission may divide the commission into

3-8 subcommittees. The commission may delegate one or more of the powers

3-9 conferred on the commission to a subcommittee of the commission.

3-10 5. The commission shall prescribe rules for its own management and

3-11 government.

3-12 Sec. 3. NRS 458.400 is hereby amended to read as follows:

3-13 458.400 1. The commission may accept gifts, grants, appropriations

3-30 fund.

3-31 Sec. 4. NRS 458.420 is hereby amended to read as follows:

3-32 458.420 The commission shall:

3-42 [(d)] and

4-1 (3) The order of priority concerning the efforts required to achieve

4-2 the goals and objectives of the commission . [; and

4-3 (e) A statement of the roles of state and local governmental agencies and

4-4 the private sector in the achievement of the goals and objectives of the

4-5 commission.]

4-6 2. Prepare and deliver to the governor on or before [September 1]

4-7 December 31 of each even-numbered year a report that summarizes the

4-8 status of the state master plan and of the efforts of the commission to

4-9 achieve its goals and objectives.

4-10 3. Hold and coordinate public hearings throughout the state as are

4-11 necessary to receive information from the public relating to education

4-12 concerning the abuse of drugs and alcohol, prevention and treatment of the

4-13 abuse of drugs and alcohol and the enforcement of laws relating to drugs

4-14 and alcohol.

4-15 4. [Encourage the creation of state and local task forces, councils and

4-16 committees relating to education concerning the abuse of drugs and

4-17 alcohol, prevention and treatment of the abuse of drugs and alcohol and

4-18 enforcement of laws relating to drugs and alcohol and develop procedures

4-19 to receive information and recommendations from the task forces, councils

4-20 and committees on a regular basis.

4-21 5.] Recommend to the governor [in its annual report] annually any

4-22 proposed legislation relating to education concerning the abuse of drugs

4-23 and alcohol, prevention and treatment of the abuse of drugs and alcohol and

4-24 enforcement of laws relating to drugs and alcohol.

4-25 5. Make grants of available money to organizations that review and

4-26 evaluate problems concerning the enforcement of laws relating to drugs

4-27 and the treatment of the abuse of drugs.

4-28 6. Collect, evaluate and disseminate information concerning [the] :

4-29 (a) The performance of the programs for [substance] drug abuse

4-30 education, prevention, enforcement and treatment [.

4-31 7. Disseminate information concerning any new developments in

4-32 research or programs for substance] ; and

4-33 (b) Proposed legislation relating to drug abuse education, prevention,

4-34 enforcement and treatment.

4-35 [8.] 7. Establish a program to recognize publicly persons and programs

4-36 that have helped to prevent and treat the abuse of drugs and alcohol and

4-37 enforce laws relating to drugs and alcohol in this state.

4-38 [9. Disseminate information concerning the provisions of NRS 62.2255

4-39 to 62.227, inclusive, with the assistance of the department of employment,

4-40 training and rehabilitation, the department of motor vehicles and public

4-41 safety, and the superintendent of public instruction.]

4-42 Sec. 5. NRS 458.410 is hereby repealed.

4-43 Sec. 6. This act becomes effective on July 1, 1999.
