AN ACT relating to health care; providing that senior citizens are eligible for Medicaid upon purchasing and receiving benefits from certain policies of insurance for long-term care; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 422 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. The director shall include in the state plan for Medicaid a

1-4 requirement that any senior citizen who purchases and receives benefits

1-5 for at least 3 years pursuant to a policy of health insurance for long-term

1-6 care that is approved by the director and whose annual household

1-7 income is less than $200,000 is eligible for Medicaid for long-term care.

1-8 2. As used in this section:

1-9 (a) "Household income" has the meaning ascribed to it in NRS

1-10 361.820.

1-11 (b) "Senior citizen" means a person who is domiciled in this state and

1-12 is 55 years of age or older.

1-13 Sec. 2. NRS 422.272 is hereby amended to read as follows:

1-14 422.272 1. [The] Except as otherwise provided in section 1 of this

1-15 act, the director shall include in the state plan for Medicaid a requirement

1-16 that the state shall pay the nonfederal share of expenditures for the medical,

2-1 administrative and [transaction] transactional costs , to the extent not

2-2 covered by private insurance, of a person:

2-3 (a) Who is admitted to a hospital, facility for intermediate care or

2-4 facility for skilled nursing for not less than 30 consecutive days;

2-5 (b) Who is covered by the state plan for Medicaid; and

2-6 (c) Whose net countable income per month is not more than $775 or 156

2-7 percent of the supplemental security income benefit rate established

2-8 pursuant to 42 U.S.C. § 1382(b)(1), whichever is greater.

2-9 2. As used in this section:

2-10 (a) "Facility for intermediate care" has the meaning ascribed to it in

2-11 NRS 449.0038.

2-12 (b) "Facility for skilled nursing" has the meaning ascribed to it in NRS

2-13 449.0039.

2-14 (c) "Hospital" has the meaning ascribed to it in NRS 449.012.

2-15 Sec. 3. Section 89 of chapter 550, Statutes of Nevada 1997, at page

2-16 2664, as last amended by section 74 of Senate Bill No. 453 of this session

2-17 is hereby amended to read as follows:

2-18 Sec. 89. 1. This section and sections 2 to [14.1,] 13,

2-19 inclusive, 14.1, 14.3 to 29, inclusive, 32 [to 43, inclusive,] 34, 35,

2-20 37, 38, 39, 41, 42, 43, 45, 47, [49] 51 to 54, inclusive, 56, 57, 59,

2-21 63, [64, 67 to 71, inclusive, and] 67, 68, 70, 71, 74 to 80.4,

2-22 inclusive, 80.7 and 81 to 88, inclusive, of this act become effective

2-23 on July 1, 1997.

2-24 2. Sections 1, [30, 30.5,] 14, 33, 36, 40, 44, 46, [48, 54.5,] 49,

2-25 50, 58, 60, [61,] 62, 64, 65, 66, 69, [72 and] 73 , 80.5 and 80.6 of

2-26 this act become effective at 12:01 a.m. on July 1, 1997.

2-27 3. Sections [31 and 55] 30, 30.5, 48, 54.5, 61 and 72 of this act

2-28 become effective at 12:02 a.m. on July 1, 1997.

2-29 4. Sections 31 and 55 of this act become effective at 12:03

2-30 a.m. on July 1, 1997.

2-31 5. Section 14.2 of this act becomes effective on July 1, 1998.

2-32 [5.] 6. Sections 1 to 14.4, inclusive, 15 to 30, inclusive, 31 to

2-33 54, inclusive, 55 to 80.3, inclusive, 80.5, 80.7 and 84 of this act,

2-34 and subsection 1 of section 81 of this act, expires by limitation on

2-35 June 30, 1999.

2-36 Sec. 4. This act becomes effective on July 1, 1999.
