AN ACT relating to motor vehicles; providing for the issuance of special license plates recognizing service as a Seabee in the United States Navy; imposing a fee for the issuance or renewal of such license plates; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 482 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. Except as otherwise provided in this section, the department, in

1-4 cooperation with residents of this state who are Seabees, shall design,

1-5 prepare and issue license plates that recognize service as a Seabee using

1-6 any colors and designs which the department deems appropriate. The

1-7 department shall not design, prepare or issue the license plates unless it

1-8 receives at least 250 applications for the issuance of those plates.

1-9 2. If the department receives at least 250 applications for the

1-10 issuance of license plates that recognize service as a Seabee, the

1-11 department shall issue those plates for a passenger car or light

1-12 commercial vehicle upon application by a person who is entitled to

1-13 license plates pursuant to NRS 482.265 and who otherwise complies with

1-14 the requirements for registration and licensing pursuant to this chapter.

1-15 A person may request that personalized prestige license plates issued

1-16 pursuant to NRS 482.3667 be combined with license plates that recognize

1-17 service as a Seabee if that person pays the fees for the personalized

2-1 prestige license plates in addition to the fees for the license plates that

2-2 recognize service as a Seabee pursuant to subsection 4.

2-3 3. An application for the issuance or renewal of license plates that

2-4 recognize service as a Seabee is void unless the application is

2-5 accompanied by documentation which, in the determination of the

2-6 department, provides reasonable proof of the identity of the applicant

2-7 and proof of his status as a Seabee. Such documentation may include,

2-8 without limitation:

2-9 (a) A copy of Department of Defense Form No. 214 (DD 214); or

2-10 (b) Indicia of membership in the Navy Seabee Veterans of America.

2-11 An applicant who has been dishonorably discharged from the United

2-12 States Navy is not eligible to receive license plates that recognize service

2-13 as a Seabee.

2-14 4. The fee for license plates that recognize service as a Seabee is $35,

2-15 in addition to all other applicable registration and license fees and motor

2-16 vehicle privilege taxes. The license plates are renewable upon the

2-17 payment of $10.

2-18 5. If, during a registration year, the holder of license plates issued

2-19 pursuant to the provisions of this section disposes of the vehicle to which

2-20 the plates are affixed, he may retain the plates and:

2-21 (a) Affix them to another vehicle that meets the requirements of this

2-22 section if the transfer and registration fees are paid as set out in this

2-23 chapter; or

2-24 (b) Within 30 days after removing the plates from the vehicle, return

2-25 them to the department.

2-26 6. As used in this section, "Seabee" means a person who is serving or

2-27 has served on active or reserve duty in the United States Navy as a

2-28 member of a construction battalion, construction brigade or underwater

2-29 construction team under the occupational rating of builder (BU),

2-30 construction electrician (CE), construction mechanic (CM), engineering

2-31 aide (EA), equipment operator (EO), steel worker (SW) or utilitiesman

2-32 (UT).

2-33 Sec. 2. NRS 482.216 is hereby amended to read as follows:

2-34 482.216 1. Upon the request of a new vehicle dealer, the department

2-35 may authorize the new vehicle dealer to:

2-36 (a) Accept applications for the registration of the new motor vehicles he

2-37 sells and the related fees and taxes;

2-38 (b) Issue certificates of registration to applicants who satisfy the

2-39 requirements of this chapter; and

2-40 (c) Accept applications for the transfer of registration pursuant to NRS

2-41 482.399 if the applicant purchased from the new vehicle dealer a new

2-42 vehicle to which the registration is to be transferred.

3-1 2. A new vehicle dealer who is authorized to issue certificates of

3-2 registration pursuant to subsection 1 shall:

3-3 (a) Transmit the applications he receives to the department within the

3-4 period prescribed by the department;

3-5 (b) Transmit the fees he collects from the applicants and properly

3-6 account for them within the period prescribed by the department;

3-7 (c) Comply with the regulations adopted pursuant to subsection 4; and

3-8 (d) Bear any cost of equipment which is necessary to issue certificates of

3-9 registration, including any computer hardware or software.

3-10 3. A new vehicle dealer who is authorized to issue certificates of

3-11 registration pursuant to subsection 1 shall not:

3-12 (a) Charge any additional fee for the performance of those services;

3-13 (b) Receive compensation from the department for the performance of

3-14 those services;

3-15 (c) Accept applications for the renewal of registration of a motor

3-16 vehicle; or

3-17 (d) Accept an application for the registration of a motor vehicle if the

3-18 applicant wishes to:

3-19 (1) Obtain special license plates pursuant to NRS 482.3667 to

3-20 482.3825, inclusive [;] , and section 1 of this act; or

3-21 (2) Claim the exemption from the vehicle privilege tax provided

3-22 pursuant to NRS 361.1565 to veterans and their relations.

3-23 4. The director shall adopt such regulations as are necessary to carry

3-24 out the provisions of this section. The regulations adopted pursuant to this

3-25 subsection must provide for:

3-26 (a) The expedient and secure issuance of license plates and decals by the

3-27 department; and

3-28 (b) The withdrawal of the authority granted to a new vehicle dealer

3-29 pursuant to subsection 1 if that dealer fails to comply with the regulations

3-30 adopted by the department.

3-31 Sec. 3. NRS 482.500 is hereby amended to read as follows:

3-32 482.500 1. Except as otherwise provided in subsection 2, whenever

3-33 upon application any duplicate or substitute certificate of registration, decal

3-34 or number plate is issued, the following fees must be paid:

3-35 For a certificate of registration $5.00

3-36 For every substitute number plate or set of plates 5.00

3-37 For every duplicate number plate or set of plates 10.00

3-38 For every decal displaying a county name .50

3-39 For every other decal (license plate sticker or tab) 5.00

3-40 2. The following fees must be paid for any replacement plate or set of

3-41 plates issued for the following special license plates:

4-1 (a) For any special plate issued pursuant to NRS 482.3667, 482.3672,

4-2 482.3675, 482.370 to 482.376, inclusive, or 482.379 to 482.3816,

4-3 inclusive, and section 1 of this act, a fee of $10.

4-4 (b) For any special plate issued pursuant to NRS 482.368, 482.3765,

4-5 482.377 or 482.378, a fee of $5.

4-6 (c) For any souvenir license plate issued pursuant to NRS 482.3825 or

4-7 sample license plate issued pursuant to NRS 482.2703, a fee equal to that

4-8 established by the director for the issuance of those plates.

4-9 3. The fees which are paid for duplicate number plates and decals

4-10 displaying county names must be deposited with the state treasurer for

4-11 credit to the motor vehicle fund and allocated to the department to defray

4-12 the costs of duplicating the plates and manufacturing the decals.

4-13 4. As used in this section:

4-14 (a) "Duplicate number plate" means a license plate or a set of license

4-15 plates issued to a registered owner which repeat the code of a plate or set of

4-16 plates previously issued to the owner to maintain his registration using the

4-17 same code.

4-18 (b) "Substitute number plate" means a license plate or a set of license

4-19 plates issued in place of a previously issued and unexpired plate or set of

4-20 plates. The plate or set of plates does not repeat the code of the previously

4-21 issued plate or set.

4-22 Sec. 4. The amendatory provisions of this act expire by limitation on

4-23 October 1, 2003, if on that date the department of motor vehicles and

4-24 public safety has received fewer than 250 applications for the issuance of a

4-25 license plate pursuant to section 1 of this act.
