AN ACT relating to motor vehicles; providing for the issuance of decals to affix to special

license plates that display emblems or other insignia of specific military units within

particular branches of the Armed Forces of the United States; and providing other

matters properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 482 of NRS is hereby amended by adding thereto a

new section to read as follows:

  1. 1. The director shall approve the design and order the preparation of
  1. decals that may be affixed by the department, upon request, to special
  1. license plates issued pursuant to NRS 482.3763. The decals must:
  1. (a) Display the emblem or other insigne of specific military units
  1. within particular branches of the Armed Forces of the United States;
  1. (b) Be no more than 1 3/4 inches in height by 1 3/4 inches in width;
  1. and
  1. (c) Be affixed to the right side of the license plates.
  1. 2. An applicant for the issuance or renewal of the special license
  1. plates described in NRS 482.3763 may obtain decals for those plates if:
  1. (a) The military unit he requests to be displayed on the decals is a
  1. recognized unit within a particular branch of the Armed Forces of the
  1. United States;
  1. (b) He meets the requirements set forth in NRS 482.3763; and
  1. (c) He provides documentation which, in the determination of the
  1. department, provides reasonable proof of the identity of the applicant
  1. and proof of his status as a member of the specific military unit to be
  1. displayed on the decals.
  1. 3. The director may use or imitate a seal, emblem or other insigne of
  1. a unit within a branch of the Armed Forces of the United States only if
  1. that use or imitation complies with the provisions of 10 U.S.C. § 1057.
  1. 4. The department may adopt regulations governing the issuance of
  1. a decal described in subsection 1.

Sec. 2. NRS 482.3764 is hereby amended to read as follows:

  1. 482.3764 1. Before the department issues to any person, pursuant to
  1. NRS 482.3763:
  1. (a) An initial set of special license plates, it shall [collect] :
  1. (1) Collect a special fee for a veterans’ home in the amount of $25 [.]
  1. ; and
  1. (2) Affix a decal to each plate if requested by an applicant who
  1. meets the requirements set forth in section 1 of this act.
  1. (b) An annual renewal sticker, it shall [collect]
  1. :
  2. (1) Collect a special fee for a veterans’ home in the amount of $20 [.]
  1. ; and
  1. (2) Affix a decal to each plate if requested by an applicant who
  1. meets the requirements set forth in section 1 of this act.
  1. 2. The department shall deposit any money collected pursuant to this
  1. section with the state treasurer for credit to the veterans’ home account.

Sec. 3. NRS 482.500 is hereby amended to read as follows:

  1. 482.500 1. Except as otherwise provided in subsection 2 [,] or 3,
  1. whenever upon application any duplicate or substitute certificate of
  1. registration, decal or number plate is issued, the following fees must be
  1. paid:
  1. For a certificate of registration $5.00
  1. For every substitute number plate or set of plates 5.00
  1. For every duplicate number plate or set of plates 10.00
  1. For every decal displaying a county name .50
  1. For every other decal, license plate sticker or tab 5.00
  1. 2. The following fees must be paid for any replacement plate or set of
  1. plates issued for the following special license plates:
  1. (a) For any special plate issued pursuant to NRS 482.3667, 482.3672,
  1. 482.3675, 482.370 to 482.376, inclusive, or 482.379 to 482.3816,
  1. inclusive, and section 1 of Senate Bill No. 204 of this [act,] session, a fee
  1. of $10.
  1. (b) For any special plate issued pursuant to NRS 482.368, 482.3765,
  1. 482.377 or 482.378, a fee of $5.
  1. (c) For any souvenir license plate issued pursuant to NRS 482.3825 or
  1. sample license plate issued pursuant to NRS 482.2703, a fee equal to that
  1. established by the director for the issuance of those plates.
  1. 3. A fee must not be charged for a duplicate or substitute decal
  1. requested pursuant to section 1 of this act.
  1. 4. The fees which are paid for duplicate number plates and decals
  1. displaying county names must be deposited with the state treasurer for
  1. credit to the motor vehicle fund and allocated to the department to defray
  1. the costs of duplicating the plates and manufacturing the decals.
  1. [4.] 5. As used in this section:
  1. (a) "Duplicate number plate" means a license plate or a set of license
  1. plates issued to a registered owner which repeat the code of a plate or set of
  1. plates previously issued to the owner to maintain his registration using the
  1. same code.

(b) "Substitute number plate" means a license plate or a set of license

plates issued in place of a previously issued and unexpired plate or set of

plates. The plate or set of plates does not repeat the code of the previously

issued plate or set.

Sec. 4. 1. This section and sections 1 and 2 of this act become

effective on October 1, 1999.

2. Section 3 of this act becomes effective at 12:01 a.m. on October 1,

1999.
