AN ACT relating to utilities; requiring an electric utility that places high-tension electrical wires on private property to offer to purchase all private property within a reasonable proximity of such wires; requiring the public utilities commission of Nevada to adopt necessary regulations; providing a penalty; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 704 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. An electric utility that places high-tension electrical wires on

1-4 private property shall, within 90 days thereafter, offer to purchase all

1-5 private property within a reasonable proximity of the high-tension

1-6 electrical wires for the fair market value of that property.

1-7 2. The commission shall adopt regulations necessary to carry out the

1-8 provisions of subsection 1, including, without limitation:

1-9 (a) The method to be used to determine the property that is within a

1-10 reasonable proximity of the high-tension electrical wires;

1-11 (b) The method to be used to determine the fair market value of the

1-12 property;

1-13 (c) The required period of validity of the offer to purchase the

1-14 property; and

1-15 (d) The method by which the owner of the property may accept or

1-16 reject the offer.

2-1 Sec. 2. NRS 704.640 is hereby amended to read as follows:

2-2 704.640 Any person who:

2-3 1. Operates any public utility to which NRS 704.005 to 704.751,

2-4 inclusive, and section 1 of this act, and NRS 704.993 to 704.999,

2-5 inclusive, apply without first obtaining a certificate of public convenience

2-6 and necessity or in violation of its terms;

2-7 2. Fails to make any return or report required by NRS 704.005 to

2-8 704.751, inclusive, and section 1 of this act, and NRS 704.993 to 704.999,

2-9 inclusive, or by the commission pursuant to NRS 704.005 to 704.751,

2-10 inclusive, and section 1 of this act, and NRS 704.993 to 704.999,

2-11 inclusive;

2-12 3. Violates, or procures, aids or abets the violating of any provision of

2-13 NRS 704.005 to 704.751, inclusive, and section 1 of this act, and NRS

2-14 704.993 to 704.999, inclusive;

2-15 4. Fails to obey any order, decision or regulation of the commission;

2-16 5. Procures, aids or abets any person in his failure to obey the order,

2-17 decision or regulation; or

2-18 6. Advertises, solicits, proffers bids or otherwise holds himself out to

2-19 perform as a public utility in violation of any of the provisions of NRS

2-20 704.005 to 704.751, inclusive, and section 1 of this act, and NRS 704.993

2-21 to 704.999, inclusive,

2-22 shall be fined not more than $500.

2-23 Sec. 3. 1. This section becomes effective upon passage and

2-24 approval.

2-25 2. Section 1 of this act becomes effective upon passage and approval

2-26 for the purpose of adopting regulations and on October 1, 1999, for all

2-27 other purposes.

2-28 3. Section 2 of this act becomes effective on October 1, 1999.
