AN ACT relating to school districts; requiring the board of trustees of a school district in a large county to establish a commission to oversee school construction; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 393 of NRS is hereby amended by adding thereto

1-2 the provisions set forth as sections 2, 3 and 4 of this act.

1-3 Sec. 2. 1. The board of trustees of a school district in a county

1-4 whose population is 400,000 or more shall establish a commission to

1-5 oversee school construction. Each trustee shall appoint one member to

1-6 the commission. A member may be appointed by a trustee regardless of

1-7 whether the member resides within the election district of the trustee.

1-8 Each member who is appointed must demonstrate qualifications to carry

1-9 out the duties of the commission.

1-10 2. The term of each member of the commission is 2 years. A vacancy

1-11 in the membership of the commission must be filled by the trustee, or his

1-12 successor, who appointed the seat that is vacant.

1-13 3. The commission shall:

1-14 (a) Elect a chairman from among its members;

1-15 (b) Prescribe rules for its own management and government and

1-16 submit the rules to the board of trustees of the school district for

1-17 ratification;

2-1 (c) Meet throughout each year at the times and places specified by a

2-2 call of the chairman or a majority of the members of the commission;

2-3 and

2-4 (d) Comply with the provisions of chapter 241 of NRS.

2-5 4. The commission may solicit recommendations from the general

2-6 public.

2-7 5. The chairman of the commission may divide the commission into

2-8 subcommittees. The commission may delegate one or more of the duties

2-9 of the commission to a subcommittee of the commission.

2-10 6. Each member of the commission is entitled to receive a salary of

2-11 $40 for each meeting of the commission that he attends or $200 per

2-12 month, whichever is less. The salaries must be paid by the school district.

2-13 Members of the commission may voluntarily waive the compensation

2-14 provided by this subsection.

2-15 Sec. 3. If a commission to oversee school construction has been

2-16 established pursuant to section 2 of this act, the board of trustees of the

2-17 school district shall:

2-18 1. Work cooperatively with the commission;

2-19 2. Prepare a 5-year plan for the construction and maintenance of

2-20 school facilities within the school district for submission to the

2-21 commission for its review and recommendations;

2-22 3. Appoint an employee of the school district who has knowledge and

2-23 experience in school construction to act as a liaison between the school

2-24 district and the commission;

2-25 4. Consider each recommendation made by the commission and, if

2-26 the board of trustees does not adopt a recommendation, state in writing

2-27 the reason for its action; and

2-28 5. Provide administrative support to the commission.

2-29 Sec. 4. A commission to oversee school construction shall:

2-30 1. Review the 5-year plan for the construction and maintenance of

2-31 school facilities submitted by the board of trustees of the school district

2-32 and make recommendations to the board of trustees for any necessary

2-33 revisions to the plan;

2-34 2. On a quarterly basis, or more frequently if the commission

2-35 determines necessary, evaluate the program of school construction and

2-36 maintenance that is designed to carry out the 5-year plan and make

2-37 recommendations to the board of trustees concerning the program;

2-38 3. Review all items listed on an agenda of the board of trustees that

2-39 relate to school construction and maintenance, including, without

2-40 limitation, items relating to the financing of school construction and

2-41 maintenance, and make recommendations for approval or revision of the

2-42 items on the agenda;

3-1 4. Make recommendations for the management of construction and

3-2 maintenance of school facilities within the school district in a manner

3-3 that ensures effective and efficient expenditure of public money; and

3-4 5. Work cooperatively with the board of trustees of the school district

3-5 to ensure that the program of school construction and maintenance is

3-6 responsive to the educational needs of pupils within the school district.

3-7 Sec. 5. On or before February 1, 2001, a commission to oversee

3-8 school construction established pursuant to section 2 of this act shall submit

3-9 a report concerning the progress and methods of operation of the

3-10 commission to the director of the legislative counsel bureau for transmittal

3-11 to the 71st session of the legislature.

3-12 Sec. 6. This act becomes effective on July 1, 1999.
