THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 393 of NRS is hereby amended by adding thereto1-2
the provisions set forth as sections 2, 3 and 4 of this act.1-3
Sec. 2. 1. The board of trustees of a school district in a county1-4
whose population is 400,000 or more may establish a commission to1-5
oversee school construction. If such a commission is established, each1-6
trustee shall appoint one member to the commission. A member may be1-7
appointed by a trustee regardless of whether the member resides within1-8
the election district of the trustee. Each member who is appointed must1-9
demonstrate qualifications to carry out the duties of the commission.1-10
2. The term of each member of the commission is 2 years. A vacancy1-11
in the membership of the commission must be filled by the trustee, or his1-12
successor, who appointed the seat that is vacant.1-13
3. If such a commission is established, the commission shall:1-14
(a) Elect a chairman from among its members;1-15
(b) Prescribe bylaws for its own management and government and1-16
submit the bylaws to the board of trustees of the school district for1-17
ratification;2-1
(c) Meet as often as is necessary for the commission to perform its2-2
duties successfully and at the times and places specified by a call of the2-3
chairman or a majority of the members of the commission; and2-4
(d) Comply with the provisions of chapter 241 of NRS.2-5
4. The commission may solicit recommendations from the general2-6
public.2-7
5. The chairman of the commission may divide the commission into2-8
subcommittees. The commission may delegate one or more of the duties2-9
of the commission to a subcommittee of the commission.2-10
6. Each member of the commission is entitled to receive a salary of2-11
$40 for each meeting of the commission that he attends or $200 per2-12
month, whichever is less. The salaries must be paid by the school district.2-13
Members of the commission may voluntarily waive the compensation2-14
provided by this subsection.2-15
Sec. 3. If a commission to oversee school construction has been2-16
established pursuant to section 2 of this act, the board of trustees of the2-17
school district shall:2-18
1. Prepare a 3-year plan for the renovation of school facilities and a2-19
5-year plan for the construction of school facilities within the school2-20
district for submission to the commission for its review and2-21
recommendations;2-22
2. Appoint the assistant superintendent of school facilities or his2-23
designee, if the board of trustees has employed a person to serve in that2-24
capacity, or otherwise appoint an employee of the school district who has2-25
knowledge and experience in school construction to act as a liaison2-26
between the school district and the commission;2-27
3. Consider each recommendation made by the commission and, if2-28
the board of trustees does not adopt a recommendation, state in writing2-29
the reason for its action and include the statement in the minutes of the2-30
board of trustees, if applicable; and2-31
4. Provide administrative support to the commission.2-32
Sec. 4. If a commission to oversee school construction is established2-33
pursuant to section 2 of this act, the commission shall:2-34
1. Work cooperatively with the board of trustees of the school district2-35
to ensure that the program of school construction and renovation is2-36
responsive to the educational needs of pupils within the school district;2-37
2. Review the 3-year plan for the renovation of school facilities and2-38
the 5-year plan for the construction of school facilities submitted by the2-39
board of trustees of the school district and make recommendations to the2-40
board of trustees for any necessary revisions to the plans;2-41
3. On a quarterly basis, or more frequently if the commission2-42
determines necessary, evaluate the program of school construction and2-43
renovation that is designed to carry out the 3-year plan and the 5-year3-1
plan and make recommendations to the board of trustees concerning the3-2
program;3-3
4. Make recommendations for the management of construction and3-4
renovation of school facilities within the school district in a manner that3-5
ensures effective and efficient expenditure of public money; and3-6
5. Submit an annual report to the oversight panel for school facilities3-7
established pursuant to NRS 393.092 that includes a summary of the3-8
progress of the construction and renovation of school facilities within the3-9
school district and the expenditure of money from the proceeds of bonds3-10
for the construction and renovation, if such information is available to3-11
the commission.3-12
Sec. 5. If a commission to oversee school construction is established3-13
pursuant to section 2 of this act, the board of trustees of the school district3-14
shall submit a report concerning the progress and methods of operation of3-15
the commission to the director of the legislative counsel bureau for3-16
transmittal to the 71st session of the legislature.3-17
Sec. 6. This act becomes effective on July 1, 1999.~
