AN ACT relating to school districts; authorizing the board of trustees of a school district in a large county to establish a commission to oversee school construction; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 393 of NRS is hereby amended by adding thereto

1-2 the provisions set forth as sections 2, 3 and 4 of this act.

1-3 Sec. 2. 1. The board of trustees of a school district in a county

1-4 whose population is 400,000 or more may establish a commission to

1-5 oversee school construction. If such a commission is established, each

1-6 trustee shall appoint one member to the commission. A member may be

1-7 appointed by a trustee regardless of whether the member resides within

1-8 the election district of the trustee. Each member who is appointed must

1-9 demonstrate qualifications to carry out the duties of the commission.

1-10 2. The term of each member of the commission is 2 years. A vacancy

1-11 in the membership of the commission must be filled by the trustee, or his

1-12 successor, who appointed the seat that is vacant.

1-13 3. If such a commission is established, the commission shall:

1-14 (a) Elect a chairman from among its members;

1-15 (b) Prescribe bylaws for its own management and government and

1-16 submit the bylaws to the board of trustees of the school district for

1-17 ratification;

2-1 (c) Meet as often as is necessary for the commission to perform its

2-2 duties successfully and at the times and places specified by a call of the

2-3 chairman or a majority of the members of the commission; and

2-4 (d) Comply with the provisions of chapter 241 of NRS.

2-5 4. The commission may solicit recommendations from the general

2-6 public.

2-7 5. The chairman of the commission may divide the commission into

2-8 subcommittees. The commission may delegate one or more of the duties

2-9 of the commission to a subcommittee of the commission.

2-10 6. Each member of the commission is entitled to receive a salary of

2-11 $40 for each meeting of the commission that he attends or $200 per

2-12 month, whichever is less. The salaries must be paid by the school district.

2-13 Members of the commission may voluntarily waive the compensation

2-14 provided by this subsection.

2-15 Sec. 3. If a commission to oversee school construction has been

2-16 established pursuant to section 2 of this act, the board of trustees of the

2-17 school district shall:

2-18 1. Prepare a 3-year plan for the renovation of school facilities and a

2-19 5-year plan for the construction of school facilities within the school

2-20 district for submission to the commission for its review and

2-21 recommendations;

2-22 2. Appoint the assistant superintendent of school facilities or his

2-23 designee, if the board of trustees has employed a person to serve in that

2-24 capacity, or otherwise appoint an employee of the school district who has

2-25 knowledge and experience in school construction to act as a liaison

2-26 between the school district and the commission;

2-27 3. Consider each recommendation made by the commission and, if

2-28 the board of trustees does not adopt a recommendation, state in writing

2-29 the reason for its action and include the statement in the minutes of the

2-30 board of trustees, if applicable; and

2-31 4. Provide administrative support to the commission.

2-32 Sec. 4. If a commission to oversee school construction is established

2-33 pursuant to section 2 of this act, the commission shall:

2-34 1. Work cooperatively with the board of trustees of the school district

2-35 to ensure that the program of school construction and renovation is

2-36 responsive to the educational needs of pupils within the school district;

2-37 2. Review the 3-year plan for the renovation of school facilities and

2-38 the 5-year plan for the construction of school facilities submitted by the

2-39 board of trustees of the school district and make recommendations to the

2-40 board of trustees for any necessary revisions to the plans;

2-41 3. On a quarterly basis, or more frequently if the commission

2-42 determines necessary, evaluate the program of school construction and

2-43 renovation that is designed to carry out the 3-year plan and the 5-year

3-1 plan and make recommendations to the board of trustees concerning the

3-2 program;

3-3 4. Make recommendations for the management of construction and

3-4 renovation of school facilities within the school district in a manner that

3-5 ensures effective and efficient expenditure of public money; and

3-6 5. Submit an annual report to the oversight panel for school facilities

3-7 established pursuant to NRS 393.092 that includes a summary of the

3-8 progress of the construction and renovation of school facilities within the

3-9 school district and the expenditure of money from the proceeds of bonds

3-10 for the construction and renovation, if such information is available to

3-11 the commission.

3-12 Sec. 5. If a commission to oversee school construction is established

3-13 pursuant to section 2 of this act, the board of trustees of the school district

3-14 shall submit a report concerning the progress and methods of operation of

3-15 the commission to the director of the legislative counsel bureau for

3-16 transmittal to the 71st session of the legislature.

3-17 Sec. 6. This act becomes effective on July 1, 1999.
