AN ACT relating to traffic laws; revising the penalty for exceeding the posted speed limit in

certain circumstances; and providing other matters properly relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 484.3685 is hereby amended to read as follows:

  1. 484.3685 1. Except as otherwise provided in subsection 3, a person
  1. driving a motor vehicle during the hours of daylight at a speed in excess of
  1. the speed limit posted by a public authority for the portion of highway
  1. being traversed shall be punished by a fine of $25 if:
  1. (a) The posted speed limit is 60 miles per hour and the person is not
  1. exceeding a speed of 70 miles per hour.
  1. (b) The posted speed limit is 65 miles per hour and the person is not
  1. exceeding a speed of 75 miles per hour.
  1. (c) The posted speed limit is 70 miles per hour and the person is not
  1. exceeding a speed of 75 miles per hour.
  1. 2. A violation of the speed limit under any of the circumstances set
  1. forth in subsection 1 must not be recorded by the department on a driver’s
  1. record and shall not be deemed a moving traffic violation.
  1. 3. The provisions of this section do not apply to a violation specified in
  1. subsection 1 that occurs in a county whose population is 100,000 or more
  1. [.] if the portion of highway being traversed is in:
  1. (a) An urban area; or
  1. (b) An area which is adjacent to an urban area and which has been
  1. designated by the public authority that established the posted speed limit
  1. for the portion of highway being traversed as an area that requires strict
  1. observance of the posted speed limit to protect public health and safety.

Sec. 2. The amendatory provisions of this act do not apply to offenses

committed before July 1, 1999.

Sec. 3. This act becomes effective on July 1, 1999.
