AN ACT relating to property; revising the definitions of "junk dealer" and "secondhand dealer" to exclude a person who engages in the business of purchasing or selling junk or secondhand personal property at certain shows or events; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 647.016 is hereby amended to read as follows:

1-2 647.016 "Junk dealer" means every person, firm or corporation

1-3 engaged in the business of purchasing or selling hides or junk. The term

1-4 does not include a person, firm or corporation that:

1-5 1. Engages in the business of purchasing or selling hides or junk at a

1-6 show or other event if the show or event:

1-7 (a) Is held at a place other than the residence or place of business of

1-8 the person, firm or corporation; and

1-9 (b) Is conducted for not more than 7 days; or

1-10 2. Organizes, operates or sponsors an event specified in subsection 1.

1-11 Sec. 2. NRS 647.018 is hereby amended to read as follows:

1-12 647.018 "Secondhand dealer" means any person engaged in whole or in

1-13 part in the business of buying and selling metal junk, melted metals or

1-14 secondhand personal property, including, without limitation, antiques and

1-15 collectibles. The term does not include a person who:

1-16 1. Engages in that business at a show or other event if the show or

1-17 event:

2-1 (a) Is held at a place other than the residence or place of business of

2-2 the person; and

2-3 (b) Is conducted for not more than 7 days; or

2-4 2. Organizes, operates or sponsors an event specified in subsection 1.
