CHAPTER........

AN ACT relating to the City of North Las Vegas; amending the city charter to provide that

the city attorney is appointed by, serves at the pleasure of, and is under the general

direction and supervision of, the city council; and providing other matters properly

relating thereto.

 

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

  1. Section 1. Section 1.080 of the charter of the City of North Las Vegas,
  1. being chapter 573, Statutes of Nevada 1971, at page 1211, is hereby
  1. amended to read as follows:
  1. Sec. 1.080 Appointment of officers; city manager’s director.
  1. 1. [All] Except as otherwise provided in section 3.050, all
  1. officers, not elected or covered under the civil service system,
  1. [shall] must be appointed by the city manager subject to ratification
  1. by the city council.
  1. 2. All departments, offices and agencies under the direction and
  1. supervision of the city manager [shall] must be administered by an
  1. officer subject to the direction and supervision of the city manager.
  1. With the consent of the city council, the city manager may serve as
  1. the head of two or more departments, offices or agencies or may
  1. appoint one person to be head of two or more departments, offices
  1. or agencies.
  1. 3. All appointive officers of the city [shall] are entitled to
  1. receive such salary as may be designated by the city council.
  1. 4. The city council may require from all other officers and
  1. employees of the city constituted or appointed under this charter,
  1. except councilmen, sufficient security for the faithful and honest
  1. performance of their respective duties.

Sec. 2. Section 3.050 of the charter of the City of North Las Vegas,

being chapter 573, Statutes of Nevada 1971, at page 1221, is hereby

amended to read as follows:

  1. Sec. 3.050 City attorney: [Qualifications; duties.]
  1. Appointment; salary; qualifications; duties; removal.
  1. 1. The city council shall appoint a city attorney and fix his
  1. salary.
  1. 2. The city attorney [shall] must be a duly licensed member of
  1. the State Bar of Nevada.
  1. [2.] 3. The city attorney [shall be] is the chief legal officer of
  1. the city and shall perform such duties as may be designated by the
  1. city council or prescribed by ordinance.

4. The city attorney is under the general direction and

supervision of the city council.

5. The city attorney serves at the pleasure of the city council

and may be removed by an affirmative vote of a majority of the

entire membership of the city council at any time.
