AN ACT relating to public utilities; requiring a public utility which does not reconstruct its facilities along a street when the street is reconstructed to ensure that the facility will provide service without substantial alteration for the life of the improvement made to the street; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 704 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 If a public utility having facilities in place along a public highway does

1-4 not reconstruct those facilities at the time the highway is reconstructed,

1-5 the public utility shall provide written assurance to the public body which

1-6 maintains the highway that the facilities will continue to provide

1-7 adequate service during the expected life of the improvement made to the

1-8 highway. If in fact a repair or enlargement of the facilities during the

1-9 expected life requires interruption of traffic or a tearing up and

1-10 replacement of any part of the highway, the public utility shall reimburse

1-11 the public body for any expense incurred and pay to the public body in

1-12 addition a penalty equal to the expense.
