AN ACT relating to animals; requiring a veterinarian who knows or has reason to know that an animal has been tortured or subjected to cruelty to report that fact to a peace officer or officer of a society for the prevention of cruelty to animals; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 574 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. A veterinarian who, in his professional capacity, knows or has reason

1-4 to know that an animal has been tortured or subjected to cruelty shall report

1-5 that fact to a peace officer or officer of a society for the prevention of

1-6 cruelty to animals who is authorized to make arrests pursuant to NRS

1-7 574.040. The report must be submitted not later than 24 hours after the

1-8 veterinarian knows or has reason to know of the torture of or cruelty to the

1-9 animal.

1-10 2. A veterinarian who violates any provision of this section is guilty of a

1-11 misdemeanor.

1-12 3. As used in this section, "veterinarian" has the meaning ascribed to it

1-13 in NRS 574.330.

1-14 Sec. 2. NRS 574.050 is hereby amended to read as follows:

1-15 574.050 As used in NRS 574.050 to 574.200, inclusive [:] , and section 1

1-16 of this act:

1-17 1. "Animal" does not include the human race, but includes every other

1-18 living creature.

2-1 2. "Torture" or "cruelty" includes every act, omission or neglect, whereby

2-2 unjustifiable physical pain, suffering or death is caused or permitted.
