THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 388 of NRS is hereby amended by adding thereto1-2
the provisions set forth as sections 2 to 9, inclusive, of this act.1-3
Sec. 2. As used in NRS 388.330 to 388.400, inclusive, and sections 21-4
to 9, inclusive, of this act, "advisory committee" means the advisory1-5
committee on technical skills for occupational education created1-6
pursuant to section 3 of this act.1-7
Sec. 3. 1. The advisory committee on technical skills for1-8
occupational education is hereby created. The advisory committee1-9
consists of nine members who are appointed as follows:1-10
(a) Five members appointed by the governor:1-11
(1) Three of whom must have experience in the field of1-12
occupational education;1-13
(2) One of whom must be a representative of a private business or1-14
industry which may be directly affected by recommendations provided by1-15
the advisory committee; and2-1
(3) One of whom must be a representative of the general public;2-2
and2-3
(b) Four members appointed by the state board of education:2-4
(1) Two of whom must have experience in the field of occupational2-5
education;2-6
(2) One of whom must be a representative of a private business or2-7
industry which may be directly affected by recommendations provided by2-8
the advisory committee; and2-9
(3) One of whom must be a representative of the general public.2-10
Persons who are appointed to the advisory committee based on their2-11
experience in the field of occupational education may also be members2-12
of the state board for occupational education.2-13
2. After the initial term, the term of a member of the advisory2-14
committee is 4 years, except when appointed to fill an unexpired term. No2-15
member may serve more than two full terms consecutively.2-16
3. A vacancy in the membership of the advisory committee must be2-17
filled for the remainder of the unexpired term in the same manner as the2-18
original appointment.2-19
4. The department shall provide administrative support to the2-20
advisory committee.2-21
Sec. 4. 1. The advisory committee shall elect a chairman from2-22
among its members.2-23
2. The term of the chairman is 1 year beginning on July 1 of each2-24
year.2-25
3. No person may serve more than two full terms consecutively as2-26
chairman.2-27
4. If a vacancy occurs in the chairmanship, the members of the2-28
advisory committee shall elect a chairman from among its members for2-29
the remainder of the unexpired term.2-30
Sec. 5. The chairman of the advisory committee shall:2-31
1. Schedule the meetings of the advisory committee; and2-32
2. Ensure that the meetings of the advisory committee are conducted2-33
so as to:2-34
(a) Carry out the business of the advisory committee in an efficient2-35
manner; and2-36
(b) Preserve order and decorum among the members of the advisory2-37
committee.2-38
Sec. 6. 1. The advisory committee shall meet at least quarterly and2-39
may meet at a call of the chairman or by vote of a majority of the2-40
members of the advisory committee.2-41
2. Five members of the advisory committee constitute a quorum to2-42
transact all business, and a majority of those present must concur on any2-43
decision.3-1
Sec. 7. Each member of the advisory committee is entitled to receive,3-2
while engaged in the business of the advisory committee, the per diem3-3
allowance and travel expenses provided for state officers and employees3-4
generally.3-5
Sec. 8. 1. The advisory committee shall:3-6
(a) Review and evaluate programs for occupational education that3-7
have been established by school districts within this state;3-8
(b) Submit recommendations to the state board for occupational3-9
education regarding:3-10
(1) Standards for occupational education; and3-11
(2) Other matters as the advisory committee deems appropriate; and3-12
(c) Review and report to the Nevada legislature regarding the3-13
standards for programs of occupational education adopted by the state3-14
board for occupational education pursuant to subsection 1 of NRS3-15
388.360.3-16
2. The board of trustees of each school district that has adopted a3-17
program of occupational education shall cooperate with and provide3-18
information to the advisory committee as necessary for the advisory3-19
committee to carry out its duties pursuant to this section.3-20
Sec. 9. 1. There is hereby created within the state treasury the fund3-21
for the improvement of programs for occupational education. The fund3-22
must be administered by the state board of education.3-23
2. The money in the fund must be used only to:3-24
(a) Pay for the establishment of and the reasonable administrative3-25
expenses incurred by the advisory committee;3-26
(b) Pay for the per diem allowance and travel expenses to which3-27
members of the advisory committee are entitled pursuant to section 7 of3-28
this act; and3-29
(c) Provide money to school districts that have adopted programs for3-30
occupational education in accordance with the standards adopted3-31
pursuant to subsection 1 of NRS 388.360 for the purchase of equipment3-32
and supplies for such programs.3-33
3. The interest and income earned on the money in the fund, after3-34
deducting any applicable charges, must be credited to the fund and may3-35
only be disbursed as authorized by the state board of education.3-36
4. The state board of education shall establish annually, within the3-37
limits of money available in the fund, a basic allocation of $25,000 to3-38
each school district that has established a program for occupational3-39
education in accordance with the standards adopted pursuant to3-40
subsection 1 of NRS 388.360.3-41
5. Any money remaining after the allocations made pursuant to3-42
subsection 4 must be allocated to school districts that have adopted a3-43
program for occupational education in accordance with the standards4-1
adopted pursuant to subsection 1 of NRS 388.360 in proportion to the4-2
total number of pupils enrolled in grades 7 to 12, inclusive, within the4-3
district on the last day of the first month of the school year preceding the4-4
school year for which the money is being provided.4-5
6. A school district that receives money pursuant to this section:4-6
(a) Shall use the money to purchase equipment and supplies for4-7
programs for occupational education.4-8
(b) Shall not use the money to:4-9
(1) Settle or arbitrate disputes or negotiate settlements between an4-10
organization that represents licensed employees of the school district and4-11
the school district;4-12
(2) Adjust the schedules of salaries and benefits of the employees of4-13
the school district; or4-14
(3) Replace the money that the school district would otherwise4-15
expend on programs for occupational education.4-16
Sec. 10. NRS 388.360 is hereby amended to read as follows: 388.360 1. The state board for occupational education shall:4-18
(a) Consider the recommendations submitted by the advisory4-19
committee pursuant to section 8 of this act; and4-20
(b) Based upon those recommendations and in consultation with the4-21
advisory committee, adopt standards for programs for occupational4-22
education.4-23
2. The state board for occupational education may:4-24

to the State of Nevada for occupational education.4-27

Sec. 11. NRS 388.400 is hereby amended to read as follows: 388.400 1. The money for occupational education must be provided5-18
for and raised in the manner specified in NRS 387.050 and 388.330 to5-19
388.400, inclusive5-20
2. The state treasurer is the custodian of the money and shall make5-21
disbursements therefrom on warrants of the state controller issued upon the5-22
order of the executive officer of the state board for occupational education.5-23
Sec. 12. On or before July 1, 1999:5-24
1. The governor shall appoint to the advisory committee on technical5-25
skills for occupational education created pursuant to section 3 of this act:5-26
(a) Two persons to terms that expire on June 30, 2001.5-27
(b) One person to a term that expires on June 30, 2002.5-28
(c) Two persons to terms that expire on June 30, 2003.5-29
2. The state board of education shall appoint to the advisory committee5-30
on technical skills for occupational education created pursuant to section 35-31
of this act:5-32
(a) One person to a term that expires on June 30, 2001.5-33
(b) Two persons to terms that expire on June 30, 2002.5-34
(c) One person to a term that expires on June 30, 2003.5-35
Sec. 13. On or before July 1, 2000, the advisory committee on5-36
technical skills for occupational education created pursuant to section 3 of5-37
this act shall:5-38
1. Complete an initial review and evaluation of each program for5-39
occupational education that has been established by a school district within5-40
this state; and5-41
2. Provide a report on that review and evaluation to the state board for5-42
occupational education, including, without limitation, recommendations for5-43
standards for programs for occupational education.6-1
Sec. 14. On or before January 1, 2001, the state board for6-2
occupational education shall adopt standards for programs for occupational6-3
education based on the findings and recommendations set forth in the6-4
report provided by the advisory committee on technical skills for6-5
occupational education pursuant to section 13 of this act.6-6
Sec. 15. On or before February 15, 2001, the advisory committee on6-7
technical skills for occupational education created pursuant to section 3 of6-8
this act shall review and report to the 71st session of the Nevada legislature6-9
regarding the standards for programs of occupational education adopted by6-10
the state board for occupational education pursuant to subsection 1 of NRS6-11
388.360 and section 14 of this act.6-12
Sec. 16. 1. There is hereby appropriated from the state general fund6-13
to the fund for the improvement of programs for occupational education6-14
created pursuant to section 9 of this act:6-15
For the fiscal year 1999-2000 $8,000,0006-16
For the fiscal year 2000-2001 $8,000,0006-17
2. The amount allocated from the fund to pay for:6-18
(a) The establishment of and the reasonable administrative expenses6-19
incurred by the advisory committee on technical skills for occupational6-20
education; and6-21
(b) The per diem allowance and travel expenses to which members of6-22
the advisory committee on technical skills for occupational education are6-23
entitled pursuant to section 7 of this act,6-24
must not exceed the sum of $15,000 in each fiscal year.6-25
3. Except as otherwise provided in subsection 2, the sums appropriated6-26
by subsection 1 must be used to make the allocations to school districts6-27
required pursuant to section 9 of this act. To receive money pursuant to this6-28
subsection, a school district shall:6-29
(a) If the state board for occupational education has not yet adopted6-30
standards for programs for occupational education pursuant to subsection 16-31
of NRS 388.360 and section 14 of this act, provide evidence to the state6-32
board of education that the school district has a program for occupational6-33
education; or6-34
(b) If the state board for occupational education has adopted standards6-35
for programs for occupational education pursuant to subsection 1 of NRS6-36
388.360 and section 14 of this act, provide evidence to the state board of6-37
education that the program of the school district for occupational education6-38
complies with those standards.6-39
4. The sums appropriated by subsection 1 are available for either fiscal6-40
year. Any balance of those sums must not be committed for expenditure6-41
after June 30, 2001, and reverts to the state general fund as soon as all6-42
payments of money committed have been made.7-1
Sec. 17. 1. This section and sections 12 and 16 of this act become7-2
effective upon passage and approval.7-3
2. Section 3 of this act becomes effective upon passage and approval7-4
for the purpose of appointing members to the advisory committee on7-5
technical skills for occupational education and on July 1, 1999, for all other7-6
purposes.7-7
3. Sections 1, 2, 4 to 11, inclusive, 13, 14 and 15 of this act become7-8
effective on July 1, 1999.~
