AN ACT relating to education; creating an advisory committee on technical skills for occupational education; providing for its membership and duties; creating a fund for the improvement of programs for occupational education; requiring the state board for occupational education to adopt standards for occupational education; making an appropriation; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 388 of NRS is hereby amended by adding thereto

1-2 the provisions set forth as sections 2 to 9, inclusive, of this act.

1-3 Sec. 2. As used in NRS 388.330 to 388.400, inclusive, and sections 2

1-4 to 9, inclusive, of this act, "advisory committee" means the advisory

1-5 committee on technical skills for occupational education created

1-6 pursuant to section 3 of this act.

1-7 Sec. 3. 1. The advisory committee on technical skills for

1-8 occupational education is hereby created. The advisory committee

1-9 consists of nine members who are appointed as follows:

1-10 (a) Five members appointed by the governor:

1-11 (1) Three of whom must have experience in the field of

1-12 occupational education;

1-13 (2) One of whom must be a representative of a private business or

1-14 industry which may be directly affected by recommendations provided by

1-15 the advisory committee; and

2-1 (3) One of whom must be a representative of the general public;

2-2 and

2-3 (b) Four members appointed by the state board of education:

2-4 (1) Two of whom must have experience in the field of occupational

2-5 education;

2-6 (2) One of whom must be a representative of a private business or

2-7 industry which may be directly affected by recommendations provided by

2-8 the advisory committee; and

2-9 (3) One of whom must be a representative of the general public.

2-10 Persons who are appointed to the advisory committee based on their

2-11 experience in the field of occupational education may also be members

2-12 of the state board for occupational education.

2-13 2. After the initial term, the term of a member of the advisory

2-14 committee is 4 years, except when appointed to fill an unexpired term. No

2-15 member may serve more than two full terms consecutively.

2-16 3. A vacancy in the membership of the advisory committee must be

2-17 filled for the remainder of the unexpired term in the same manner as the

2-18 original appointment.

2-19 4. The department shall provide administrative support to the

2-20 advisory committee.

2-21 Sec. 4. 1. The advisory committee shall elect a chairman from

2-22 among its members.

2-23 2. The term of the chairman is 1 year beginning on July 1 of each

2-24 year.

2-25 3. No person may serve more than two full terms consecutively as

2-26 chairman.

2-27 4. If a vacancy occurs in the chairmanship, the members of the

2-28 advisory committee shall elect a chairman from among its members for

2-29 the remainder of the unexpired term.

2-30 Sec. 5. The chairman of the advisory committee shall:

2-31 1. Schedule the meetings of the advisory committee; and

2-32 2. Ensure that the meetings of the advisory committee are conducted

2-33 so as to:

2-34 (a) Carry out the business of the advisory committee in an efficient

2-35 manner; and

2-36 (b) Preserve order and decorum among the members of the advisory

2-37 committee.

2-38 Sec. 6. 1. The advisory committee shall meet at least quarterly and

2-39 may meet at a call of the chairman or by vote of a majority of the

2-40 members of the advisory committee.

2-41 2. Five members of the advisory committee constitute a quorum to

2-42 transact all business, and a majority of those present must concur on any

2-43 decision.

3-1 Sec. 7. Each member of the advisory committee is entitled to receive,

3-2 while engaged in the business of the advisory committee, the per diem

3-3 allowance and travel expenses provided for state officers and employees

3-4 generally.

3-5 Sec. 8. 1. The advisory committee shall:

3-6 (a) Review and evaluate programs for occupational education that

3-7 have been established by school districts within this state;

3-8 (b) Submit recommendations to the state board for occupational

3-9 education regarding:

3-10 (1) Standards for occupational education; and

3-11 (2) Other matters as the advisory committee deems appropriate; and

3-12 (c) Review and report to the Nevada legislature regarding the

3-13 standards for programs of occupational education adopted by the state

3-14 board for occupational education pursuant to subsection 1 of NRS

3-15 388.360.

3-16 2. The board of trustees of each school district that has adopted a

3-17 program of occupational education shall cooperate with and provide

3-18 information to the advisory committee as necessary for the advisory

3-19 committee to carry out its duties pursuant to this section.

3-20 Sec. 9. 1. There is hereby created within the state treasury the fund

3-21 for the improvement of programs for occupational education. The fund

3-22 must be administered by the state board of education.

3-23 2. The money in the fund must be used only to:

3-24 (a) Pay for the establishment of and the reasonable administrative

3-25 expenses incurred by the advisory committee;

3-26 (b) Pay for the per diem allowance and travel expenses to which

3-27 members of the advisory committee are entitled pursuant to section 7 of

3-28 this act; and

3-29 (c) Provide money to school districts that have adopted programs for

3-30 occupational education in accordance with the standards adopted

3-31 pursuant to subsection 1 of NRS 388.360 for the purchase of equipment

3-32 and supplies for such programs.

3-33 3. The interest and income earned on the money in the fund, after

3-34 deducting any applicable charges, must be credited to the fund and may

3-35 only be disbursed as authorized by the state board of education.

3-36 4. The state board of education shall establish annually, within the

3-37 limits of money available in the fund, a basic allocation of $25,000 to

3-38 each school district that has established a program for occupational

3-39 education in accordance with the standards adopted pursuant to

3-40 subsection 1 of NRS 388.360.

3-41 5. Any money remaining after the allocations made pursuant to

3-42 subsection 4 must be allocated to school districts that have adopted a

3-43 program for occupational education in accordance with the standards

4-1 adopted pursuant to subsection 1 of NRS 388.360 in proportion to the

4-2 total number of pupils enrolled in grades 7 to 12, inclusive, within the

4-3 district on the last day of the first month of the school year preceding the

4-4 school year for which the money is being provided.

4-5 6. A school district that receives money pursuant to this section:

4-6 (a) Shall use the money to purchase equipment and supplies for

4-7 programs for occupational education.

4-8 (b) Shall not use the money to:

4-9 (1) Settle or arbitrate disputes or negotiate settlements between an

4-10 organization that represents licensed employees of the school district and

4-11 the school district;

4-12 (2) Adjust the schedules of salaries and benefits of the employees of

4-13 the school district; or

4-14 (3) Replace the money that the school district would otherwise

4-15 expend on programs for occupational education.

4-16 Sec. 10. NRS 388.360 is hereby amended to read as follows:

4-17 388.360 1. The state board for occupational education shall:

4-18 (a) Consider the recommendations submitted by the advisory

4-19 committee pursuant to section 8 of this act; and

4-20 (b) Based upon those recommendations and in consultation with the

4-21 advisory committee, adopt standards for programs for occupational

4-22 education.

4-23 2. The state board for occupational education may:

4-24 [1.] (a) Cooperate with any federal agency, board or department

4-25 designated to administer the Acts of Congress apportioning federal money

4-26 to the State of Nevada for occupational education.

4-27 [2.] (b) Establish policies and adopt regulations for the administration

4-28 of any legislation enacted pursuant thereto by the State of Nevada.

4-29 [3.] (c) Establish policies and adopt regulations for the administration

4-30 of money provided by the Federal Government and the State of Nevada for

4-31 the promotion, extension and improvement of occupational education in

4-32 Nevada.

4-33 [4.] (d) Establish policies or regulations and formulate plans for the

4-34 promotion of occupational education in such subjects as are an essential

4-35 and integral part of the system of public education in the State of Nevada.

4-36 [5.] (e) Establish policies to provide for the preparation of teachers of

4-37 such programs and subjects.

4-38 [6.] (f) Approve positions for such persons as may be necessary to

4-39 administer the federal act and provisions of this Title enacted pursuant

4-40 thereto for the State of Nevada.

4-41 [7.] (g) Direct its executive officer to make studies and investigations

4-42 relating to occupational education.

5-1 [8.] (h) Establish policies to promote and aid in the establishment by

5-2 local communities of schools, departments or classes giving training in

5-3 occupational subjects.

5-4 [9.] (i) Cooperate with local communities in the maintenance of such

5-5 schools, departments or classes.

5-6 [10.] (j) Prescribe qualifications for the teachers, directors and

5-7 supervisors of occupational subjects.

5-8 [11.] (k) Provide for the certification of such teachers, directors and

5-9 supervisors.

5-10 [12.] (l) Establish policies or regulations to cooperate in the

5-11 maintenance of classes supported and controlled by the public for the

5-12 preparation of the teachers, directors and supervisors of occupational

5-13 subjects, or maintain such classes under its own direction and control.

5-14 [13.] (m) Establish by regulation the qualifications required for persons

5-15 engaged in the training of occupational teachers.

5-16 Sec. 11. NRS 388.400 is hereby amended to read as follows:

5-17 388.400 1. The money for occupational education must be provided

5-18 for and raised in the manner specified in NRS 387.050 and 388.330 to

5-19 388.400, inclusive [.] , and sections 2 to 9, inclusive, of this act.

5-20 2. The state treasurer is the custodian of the money and shall make

5-21 disbursements therefrom on warrants of the state controller issued upon the

5-22 order of the executive officer of the state board for occupational education.

5-23 Sec. 12. On or before July 1, 1999:

5-24 1. The governor shall appoint to the advisory committee on technical

5-25 skills for occupational education created pursuant to section 3 of this act:

5-26 (a) Two persons to terms that expire on June 30, 2001.

5-27 (b) One person to a term that expires on June 30, 2002.

5-28 (c) Two persons to terms that expire on June 30, 2003.

5-29 2. The state board of education shall appoint to the advisory committee

5-30 on technical skills for occupational education created pursuant to section 3

5-31 of this act:

5-32 (a) One person to a term that expires on June 30, 2001.

5-33 (b) Two persons to terms that expire on June 30, 2002.

5-34 (c) One person to a term that expires on June 30, 2003.

5-35 Sec. 13. On or before July 1, 2000, the advisory committee on

5-36 technical skills for occupational education created pursuant to section 3 of

5-37 this act shall:

5-38 1. Complete an initial review and evaluation of each program for

5-39 occupational education that has been established by a school district within

5-40 this state; and

5-41 2. Provide a report on that review and evaluation to the state board for

5-42 occupational education, including, without limitation, recommendations for

5-43 standards for programs for occupational education.

6-1 Sec. 14. On or before January 1, 2001, the state board for

6-2 occupational education shall adopt standards for programs for occupational

6-3 education based on the findings and recommendations set forth in the

6-4 report provided by the advisory committee on technical skills for

6-5 occupational education pursuant to section 13 of this act.

6-6 Sec. 15. On or before February 15, 2001, the advisory committee on

6-7 technical skills for occupational education created pursuant to section 3 of

6-8 this act shall review and report to the 71st session of the Nevada legislature

6-9 regarding the standards for programs of occupational education adopted by

6-10 the state board for occupational education pursuant to subsection 1 of NRS

6-11 388.360 and section 14 of this act.

6-12 Sec. 16. 1. There is hereby appropriated from the state general fund

6-13 to the fund for the improvement of programs for occupational education

6-14 created pursuant to section 9 of this act:

6-15 For the fiscal year 1999-2000 $8,000,000

6-16 For the fiscal year 2000-2001 $8,000,000

6-17 2. The amount allocated from the fund to pay for:

6-18 (a) The establishment of and the reasonable administrative expenses

6-19 incurred by the advisory committee on technical skills for occupational

6-20 education; and

6-21 (b) The per diem allowance and travel expenses to which members of

6-22 the advisory committee on technical skills for occupational education are

6-23 entitled pursuant to section 7 of this act,

6-24 must not exceed the sum of $15,000 in each fiscal year.

6-25 3. Except as otherwise provided in subsection 2, the sums appropriated

6-26 by subsection 1 must be used to make the allocations to school districts

6-27 required pursuant to section 9 of this act. To receive money pursuant to this

6-28 subsection, a school district shall:

6-29 (a) If the state board for occupational education has not yet adopted

6-30 standards for programs for occupational education pursuant to subsection 1

6-31 of NRS 388.360 and section 14 of this act, provide evidence to the state

6-32 board of education that the school district has a program for occupational

6-33 education; or

6-34 (b) If the state board for occupational education has adopted standards

6-35 for programs for occupational education pursuant to subsection 1 of NRS

6-36 388.360 and section 14 of this act, provide evidence to the state board of

6-37 education that the program of the school district for occupational education

6-38 complies with those standards.

6-39 4. The sums appropriated by subsection 1 are available for either fiscal

6-40 year. Any balance of those sums must not be committed for expenditure

6-41 after June 30, 2001, and reverts to the state general fund as soon as all

6-42 payments of money committed have been made.

7-1 Sec. 17. 1. This section and sections 12 and 16 of this act become

7-2 effective upon passage and approval.

7-3 2. Section 3 of this act becomes effective upon passage and approval

7-4 for the purpose of appointing members to the advisory committee on

7-5 technical skills for occupational education and on July 1, 1999, for all other

7-6 purposes.

7-7 3. Sections 1, 2, 4 to 11, inclusive, 13, 14 and 15 of this act become

7-8 effective on July 1, 1999.
