AN ACT relating to regional planning; authorizing peace officers to issue a warning and provide certain information to persons who violate certain ordinances adopted by the Tahoe Regional Planning Agency; requiring peace officers who issue a warning to such persons to report certain information to the Tahoe Regional Planning Agency; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 277 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. Except as otherwise provided in subsection 3, every game warden,

1-4 sheriff and other peace officer of this state and its political subdivisions

1-5 may issue one or more of the following:

1-6 (a) Educational material provided by the Tahoe Regional Planning

1-7 Agency;

1-8 (b) An oral advisory; or

1-9 (c) A warning citation,

1-10 to a person who violates, within the portion of the region that is within

1-11 the waters of this state, section 54.16(A), 54.16(B) or 81.2(E) of the Code

1-12 of Ordinances adopted by the Tahoe Regional Planning Agency and in

1-13 effect on April 1, 1999.

2-1 2. A game warden, sheriff or other peace officer who issues a

2-2 warning citation pursuant to subsection 1 shall report the name and

2-3 address of the person to whom such warning was issued to the Tahoe

2-4 Regional Planning Agency.

2-5 3. An agency that provides law enforcement or other public safety

2-6 services is not subject to the provisions of section 54.16(A), 54.16(B) or

2-7 81.2(E) of the Code of Ordinances adopted by the Tahoe Regional

2-8 Planning Agency and in effect on April 1, 1999, when performing its

2-9 official duties during an emergency or disaster on the waters of Lake

2-10 Tahoe if such duties are performed in an effort to protect life or property.

2-11 4. As used in this section:

2-12 (a) "Region" has the meaning ascribed to it in NRS 277.200.

2-13 (b) "Waters of this state" means any waters within the territorial limits

2-14 of this state.

2-15 Sec. 2. NRS 277.207 is hereby amended to read as follows:

2-16 277.207 All judicial actions and proceedings in which there may arise

2-17 a question of the validity of any matter under the provisions of NRS

2-18 277.190 to 277.220, inclusive, and section 1 of this act, shall be advanced

2-19 as a matter of immediate public interest and concern, and be heard at the

2-20 earliest practicable moment.

2-21 Sec. 3. This act becomes effective upon passage and approval.
