AN ACT relating to deposits of state money; changing the date by which certain state money must be deposited by the division of state parks of the state department of conservation and natural resources; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 353.250 is hereby amended to read as follows:

1-2 353.250 1. The state treasurer shall designate the financial

1-3 institutions into which money received by a state officer, department or

1-4 commission must be deposited.

1-5 2. Except as otherwise provided in subsections 3 [and 4,] , 4 and 5,

1-6 every state officer, department or commission which receives or which may

1-7 receive any money of the State of Nevada or for its use and benefit shall

1-8 deposit on Thursday of each week, in a financial institution designated by

1-9 the state treasurer to the credit of the state treasurer’s account, all money

1-10 received by that officer, department or commission during the previous

1-11 week. If Thursday of a particular week is not a banking day, then such a

1-12 deposit must be made on the next banking day following that Thursday.

1-13 3. Except as otherwise provided in subsection 4, if on any day the

1-14 money accumulated for deposit is $10,000 or more, a deposit must be made

1-15 not later than the next [working] banking day.

2-1 4. If the division of wildlife of the state department of conservation and

2-2 natural resources accumulates for deposit $10,000 or more on any day, the

2-3 money must be deposited within 10 working days.

2-4 5. Except as otherwise provided by this subsection, money received

2-5 by the division of state parks of the state department of conservation and

2-6 natural resources must be deposited not later than 10 working days after

2-7 the date of receipt. If on any day the division of state parks of the state

2-8 department of conservation and natural resources has accumulated for

2-9 deposit:

2-10 (a) One thousand dollars or more but less than $10,000 since the last

2-11 deposit, the money must be deposited not later than the next Thursday

2-12 following such a day. If Thursday is not a banking day, then the deposit

2-13 must be made on the next banking day following that Thursday.

2-14 (b) Ten thousand dollars or more since the last deposit, the money

2-15 must be deposited not later than the next banking day.

2-16 6. Every officer, department or commission which is required to

2-17 deposit money with the state treasurer shall comply with that requirement

2-18 by depositing the money in a financial institution designated by the state

2-19 treasurer to the credit of the state treasurer’s account.

2-20 [6.] 7. Every officer, head of any department or commissioner who

2-21 fails to comply with the provisions of this section is guilty of a

2-22 misdemeanor in office.

2-23 [7.] 8. As used in this section, "financial institution" means a bank,

2-24 savings and loan association, thrift company or credit union regulated

2-25 pursuant to Title 55 or 56 of NRS.

2-26 Sec. 2. This act becomes effective on July 1, 1999.
