AN ACT relating to education; revising the membership of the commission on professional standards in education; providing for the appointment of new members to the commission; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 391.011 is hereby amended to read as follows:

1-2 391.011 1. The commission on professional standards in education,

1-3 consisting of nine members [appointed by the governor,] is hereby created.

1-4 2. [Four members of the commission must be teachers who teach in the

1-5 classroom] The governor shall appoint five members to the commission

1-6 as follows:

1-7 (a) One [who teaches in a secondary school.] member who is a teacher,

1-8 administrator, counselor or psychologist in a high school.

1-9 (b) One [who teaches] member who is a teacher, administrator,

1-10 counselor or psychologist in a middle school or junior high school.

1-11 (c) One [who teaches] member who is a teacher, administrator,

1-12 counselor or psychologist in an elementary school.

1-13 (d) [One who teaches special education.

1-14 3. The remaining members of the commission must include:

1-15 (a) One counselor or] Two members who are not employed by or

1-16 otherwise affiliated with a public or private school in this state.

2-1 3. The majority leader of the senate and the speaker of the assembly

2-2 shall each appoint two members to the commission as follows:

2-3 (a) One of whom is a:

2-4 (1) Teacher, administrator, counselor or psychologist employed by a

2-5 school district [.

2-6 (b) Two administrators of schools, at least one of whom must be a

2-7 principal of a school.

2-8 (c) The dean] or a private school licensed pursuant to chapter 394 of

2-9 NRS; or

2-10 (2) Representative of [the] a College of Education at one of the

2-11 universities in the University and Community College System of Nevada,

2-12 [or a representative of one of the Colleges of Education nominated by such]

2-13 nominated by a dean of that college for appointment . [by the governor.

2-14 (d) One member who is a representative of the general public.

2-15 4. The appointments of a counselor, the administrators and three of the

2-16 four teachers must be made from a list of names of at least three persons for

2-17 each position that is submitted to the governor:

2-18 (a) For the counselor and teachers, by an employee organization

2-19 representing the majority of counselors and the majority of teachers in the

2-20 State of Nevada who teach in the educational level from which the

2-21 appointment is being made; or

2-22 (b) For administrators, by an organization of administrators for schools

2-23 in which the majority of administrators of schools in this state have

2-24 membership.

2-25 5.] (b) One of whom is a representative of a private business or

2-26 industry.

2-27 4. One member of the commission appointed by the governor who is a

2-28 teacher, administrator, counselor or psychologist must be employed by a

2-29 private school licensed pursuant to chapter 394 of NRS.

2-30 Sec. 2. NRS 391.013 is hereby amended to read as follows:

2-31 391.013 1. Except as otherwise provided for an initial term, the

2-32 term of each member of the commission is 3 years. No member of the

2-33 commission who is a teacher, counselor [, administrator or representative of

2-34 the general public] or administrator may serve more than two terms.

2-35 2. A vacancy in the membership of the commission must be filled for

2-36 the remainder of the unexpired term in the same manner as the original

2-37 appointment.

2-38 Sec. 3. 1. The terms of office of all members appointed to the

2-39 commission on professional standards in education who are incumbent on

2-40 June 30, 1999, expire on that date.

2-41 2. Not later than July 1, 1999, appointments to the commission on

2-42 professional standards in education pursuant to the amendatory provisions

2-43 of section 1 of this act must be made as follows:

3-1 (a) Two members appointed by the governor, one member appointed by

3-2 the majority leader of the senate and one member appointed by the speaker

3-3 of the assembly must be appointed to terms expiring on June 30, 2001.

3-4 (b) Three members appointed by the governor, one member appointed

3-5 by the majority leader of the senate and one member appointed by the

3-6 speaker of the assembly must be appointed to terms expiring on June 30,

3-7 2002.

3-8 Such appointments may include members whose terms expired pursuant to

3-9 subsection 1.

3-10 Sec. 4. This act becomes effective upon passage and approval.
