AN ACT relating to public assistance; clarifying the authority of the welfare division of the

department of human resources to establish a system for producing digital images of the fingerprints of applicants for and recipients of public assistance; requiring an applicant for or recipient of public assistance to allow a digital

image of his fingerprints to be provided as a condition of receiving assistance under certain circumstances; limiting the use and providing for the confidentiality of information obtained therefrom; and providing other matters

properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 422 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. The welfare division may establish and operate an electronic

1-4 system for producing and storing digital images of the fingerprints of

1-5 applicants for and recipients of public assistance to prevent fraud in the

1-6 receipt of such assistance.

1-7 2. If such a system is established:

1-8 (a) Any information obtained thereby is confidential and may be used

1-9 only for purposes directly connected with the administration of this

1-10 chapter.

1-11 (b) An applicant for or recipient of public assistance must allow a

1-12 digital image of his fingerprints to be produced as a condition to the

1-13 receipt of public assistance, except as otherwise provided by the welfare

1-14 division.

2-1 (c) The welfare division may contract with a public or private entity

2-2 for the establishment, maintenance and operation of the system.

2-3 Sec. 2. This act becomes effective upon passage and approval.
