AN ACT relating to medical laboratories; revising the provisions governing the requirements

to qualify for certification as an assistant in a medical laboratory; authorizing licensed or certified personnel of a medical laboratory to perform certain tests without obtaining a license for that purpose; and providing other matters

properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 652 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 To qualify for certification as an assistant in a medical laboratory, a

1-4 person must be a high school graduate or have a general equivalency

1-5 diploma and:

1-6 1. Must complete at least 6 months of training approved by the board

1-7 and demonstrate an ability to perform laboratory procedures in the

1-8 medical laboratory where he receives the training; or

1-9 2. Must:

1-10 (a) Complete a course of instruction that qualifies him to take an

1-11 examination for certification in phlebotomy that is administered by:

1-12 (1) The American Medical Technologists;

1-13 (2) The American Society of Clinical Pathologists; or

1-14 (3) The National Certification Agency; and

1-15 (b) Pass an examination specified in paragraph (a).

2-1 Sec. 2. NRS 652.130 is hereby amended to read as follows:

2-2 652.130 [The] Except as otherwise provided in section 1 of this act,

2-3 the board, with the advice of the medical laboratory advisory committee,

2-4 may prescribe and publish rules and regulations relating to:

1. The education, training and experience qualifications of laboratory

2-5 directors and technical personnel.

2. The location and construction of laboratories , including plumbing,

2-6 heating, lighting, ventilation, electrical services and similar conditions , [all]

2-7 to ensure the conduct and operation of the laboratory in a manner which will

protect the public health.

2-8 3. Sanitary conditions within the laboratory and its surroundings,

including the water supply, sewage, the handling of specimens and matters

2-9 of general hygiene, to [insure] ensure the protection of the public health.

2-10 4. The equipment essential to the proper conduct and operation of a

laboratory.

2-11 5. The determination of the accuracy of test results produced by a

laboratory and the establishment of minimum qualifications therefor.

2-12 Sec. 3. NRS 652.217 is hereby amended to read as follows:

2-13 652.217 1. A licensed nurse who is employed by a medical facility

which is licensed pursuant to chapter 449 of NRS may perform any

2-14 laboratory test which is classified as a waived test pursuant to Subpart A of

Part 493 of Title 42 of the Code of Federal Regulations if the laboratory

2-15 director or a person he has designated:

2-16 [1.] (a) Verifies that the nurse is competent to perform the test;

[2.] (b) Ensures that the test is performed in accordance with any

2-17 manufacturer’s instructions; and

[3.] (c) Validates and verifies the manner in which the test is performed

2-18 through the use of controls which [assure] ensure accurate and reliable

2-19 results of the test.

2. Licensed or certified personnel of a laboratory licensed pursuant

2-20 to this chapter may perform any laboratory test which is classified as a

waived test pursuant to Subpart A of Part 493 of Title 42 of the Code of

2-21 Federal Regulations on the premises of an outpatient center of the

2-22 laboratory or at a patient’s residence if the laboratory director or a

person he has designated:

2-23 (a) Verifies that the person is competent to perform the test;

(b) Ensures that the test is performed in accordance with any

2-24 manufacturer’s instructions;

2-25 (c) Validates and verifies the manner in which the test is performed

through the use of controls which ensure accurate and reliable results of

2-26 the test; and

2-27 (d) Ensures compliance with any requirements for safety adopted by

2-28 the board.
