AN ACT relating to medical laboratories; revising the provisions governing the requirements
to qualify for certification as an assistant in a medical laboratory; authorizing licensed or certified personnel of a medical laboratory to perform certain tests without obtaining a license for that purpose; and providing other matters
properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 652 of NRS is hereby amended by adding thereto a1-2
new section to read as follows:1-3
To qualify for certification as an assistant in a medical laboratory, a1-4
person must be a high school graduate or have a general equivalency1-5
diploma and:1-6
1. Must complete at least 6 months of training approved by the board1-7
and demonstrate an ability to perform laboratory procedures in the1-8
medical laboratory where he receives the training; or1-9
2. Must:1-10
(a) Complete a course of instruction that qualifies him to take an1-11
examination for certification in phlebotomy that is administered by:1-12
(1) The American Medical Technologists;1-13
(2) The American Society of Clinical Pathologists; or1-14
(3) The National Certification Agency; and1-15
(b) Pass an examination specified in paragraph (a).2-1
Sec. 2. NRS 652.130 is hereby amended to read as follows: 652.1302-3
the board, with the advice of the medical laboratory advisory committee,2-4
may prescribe and publish rules and regulations relating to:1. The education, training and experience qualifications of laboratory

directors and technical personnel.2. The location and construction of laboratories
, including plumbing,2-6
heating, lighting, ventilation, electrical services and similar conditions ,2-7
to ensure the conduct and operation of the laboratory in a manner which willprotect the public health.

3. Sanitary conditions within the laboratory and its surroundings,including the water supply, sewage, the handling of specimens and matters

of general hygiene, to2-10
4. The equipment essential to the proper conduct and operation of alaboratory.

5. The determination of the accuracy of test results produced by alaboratory and the establishment of minimum qualifications therefor.

Sec. 3. NRS 652.217 is hereby amended to read as follows: 652.217 1. A licensed nurse who is employed by a medical facilitywhich is licensed pursuant to chapter 449 of NRS may perform any

laboratory test which is classified as a waived test pursuant to Subpart A ofPart 493 of Title 42 of the Code of Federal Regulations if the laboratory

director or a person he has designated:2-16

manufacturer’s instructions; and

through the use of controls which2-19
results of the test.2. Licensed or certified personnel of a laboratory licensed pursuant

to this chapter may perform any laboratory test which is classified as awaived test pursuant to Subpart A of Part 493 of Title 42 of the Code of

Federal Regulations on the premises of an outpatient center of the2-22
laboratory or at a patient’s residence if the laboratory director or aperson he has designated:

(a) Verifies that the person is competent to perform the test;(b) Ensures that the test is performed in accordance with any
2-24
manufacturer’s instructions;2-25
(c) Validates and verifies the manner in which the test is performedthrough the use of controls which ensure accurate and reliable results of

the test; and2-27
(d) Ensures compliance with any requirements for safety adopted by2-28
the board.~
