AN ACT relating to traffic laws; requiring that the signs designating the speed limit in a school zone or school crossing zone indicate the times during which the speed limit is in effect; providing for the designation of such times; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. NRS 484.366 is hereby amended to read as follows:

1-2 484.366 1. A person shall not drive a motor vehicle at a speed in

1-3 excess of 15 miles per hour in an area designated as a school zone except:

1-4 (a) On a day on which school is not in session;

1-5 (b) During the period from a half hour after school is no longer in

1-6 operation to a half hour before school is next in operation; [or]

1-7 (c) If the zone is designated by an operational speed limit beacon,

1-8 during the hours when the pupils of the school are in class and the yellow

1-9 lights of the speed limit beacon are not flashing in the manner which

1-10 indicates that the speed limit is in effect [.] ; or

1-11 (d) If the zone is not designated by an operational speed limit beacon,

1-12 during the times when the sign designating the school zone indicates that

1-13 the speed limit is not in effect.

1-14 2. A person shall not drive a motor vehicle at a speed in excess of 25

1-15 miles per hour in an area designated as a school crossing zone except:

1-16 (a) On a day on which school is not in session;

1-17 (b) During the period from a half hour after school is no longer in

1-18 operation to a half hour before school is next in operation; [or]

2-1 (c) If the zone is designated by an operational speed limit beacon,

2-2 during the hours when the pupils of the school are in class and the yellow

2-3 lights of the speed limit beacon are not flashing in the manner which

2-4 indicates that the speed limit is in effect [.] ; or

2-5 (d) If the zone is not designated by an operational speed limit beacon,

2-6 during the times when the sign designating the school zone indicates that

2-7 the speed limit is not in effect.

2-8 3. The governing body of a local government or the department of

2-9 transportation shall designate school zones and school crossing zones. An

2-10 area must not be designated as a school zone if imposing a speed limit of

2-11 15 miles per hour would be unsafe because of higher speed limits in

2-12 adjoining areas.

2-13 4. Each such governing body and the department shall provide signs to

2-14 mark the beginning and end of each school zone and school crossing zone

2-15 which it respectively designates. Each sign marking the beginning of such

2-16 a zone must include a designation of the hours when the speed limit is in

2-17 effect or that the speed limit is in effect when children are present.

2-18 5. With respect to each school zone and school crossing zone in a

2-19 school district, the superintendent of the school district or his designee, in

2-20 conjunction with the department of transportation and the governing

2-21 body of the local government that designated the school zone or school

2-22 crossing zone and after consulting with the principal of the school and

2-23 the agency that is responsible for enforcing the speed limit in the zone,

2-24 shall determine the times when the speed limit is in effect.

2-25 6. As used in this section, "speed limit beacon" means a device which

2-26 is used in conjunction with a sign and equipped with two or more yellow

2-27 lights that flash alternately to indicate when the speed limit in a school zone

2-28 or school crossing zone is in effect.

2-29 Sec. 2. NRS 268.425 is hereby amended to read as follows:

2-30 268.425 The city council or other governing body of each incorporated

2-31 city, whether incorporated by general or special act, shall cause to be

2-32 displayed, in each school zone and school crossing zone where the city has

2-33 posted a speed limit, signs or other devices designating the [hours of the

2-34 day or night or both] times during which the speed limit in the zone is to

2-35 apply.

2-36 Sec. 3. NRS 269.185 is hereby amended to read as follows:

2-37 269.185 1. In addition to the powers and jurisdiction conferred upon

2-38 the town boards or boards of county commissioners by this chapter, such

2-39 boards may:

2-40 (a) Regulate traffic upon the streets and alleys of towns or cities

2-41 governed by such boards pursuant to this chapter.

2-42 (b) Regulate the speed, parking, stopping, turning and operation of all

2-43 motor vehicles and other vehicles using the streets and alleys.

3-1 (c) Pass and adopt all ordinances, rules and regulations, and do and

3-2 perform all acts and things necessary for the execution of the powers and

3-3 jurisdiction conferred by this section.

3-4 2. The town board or board of county commissioners shall cause to be

3-5 displayed, in each school zone and school crossing zone where the county

3-6 has posted a speed limit, signs or other devices designating the [hours of

3-7 the day or night or both] times during which the speed limit in the zone is

3-8 to apply.

3-9 Sec. 4. Notwithstanding the provisions of subsections 4 and 5 of NRS

3-10 484.366, as amended by this act, a sign which is in existence on October 1,

3-11 1999, to mark the beginning of a school zone or school crossing zone need

3-12 not be replaced to comply with the provisions of NRS 484.366, as amended

3-13 by this act, until the sign would have otherwise been replaced in the normal

3-14 course of maintaining the sign.
