AN ACT relating to educational personnel; requiring the boards of trustees of school districts to pay the cost for a licensed teacher to purchase retirement credit if the teacher provides instruction in certain schools; and providing other matters properly

relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 391 of NRS is hereby amended by adding thereto a

1-2 new section to read as follows:

1-3 1. Except as otherwise provided in subsection 3 of this section and

1-4 except as otherwise required as a result of NRS 286.537, the board of

1-5 trustees of a school district shall pay the cost for a licensed teacher to

1-6 purchase one-fifth of a year of service pursuant to subsection 2 of NRS

1-7 286.300 if:

1-8 (a) The teacher is a member of the public employees’ retirement

1-9 system and has at least 5 years of service;

1-10 (b) The teacher has been employed as a licensed teacher in this state

1-11 for at least 5 consecutive school years, regardless of whether the

1-12 employment was with one or more school districts in this state;

1-13 (c) Each evaluation of the teacher conducted pursuant to NRS 391.3125 is at least satisfactory for 1-14 the years of employment required by

1-15 paragraph (b); and

2-1 (d) In addition to the years of employment required by paragraph (b),

2-2 the teacher has been employed as a licensed teacher for 1 school year at a

2-3 school within the school district:

2-4 (1) Which, for that school year, carries the designation of

demonstrating inadequate achievement pursuant to NRS 385.367; or

2-5 (2) Where, for that school year, at least 65 percent of the pupils who

are enrolled in the school are pupils at risk.

2-6 2. Except as otherwise provided in subsection 3, the board of trustees

2-7 of a school district shall pay the cost for a licensed teacher to purchase

one-fifth of a year of service for each year that a teacher is employed as a

2-8 teacher at a school within the school district that is described in

paragraph (d) of subsection 1.

2-9 3. In no event may the years of service purchased by a licensed

2-10 teacher as a result of subsection 2 of NRS 286.300 exceed 5 years.

4. The board of trustees of a school district shall not:

2-11 (a) Assign or reassign a licensed teacher to circumvent the

requirements of this section.

2-12 (b) Include, as part of a teacher’s salary, the costs of paying the

2-13 teacher to purchase service pursuant to this section.

5. As used in this section:

2-14 (a) "Pupil at risk" has the meaning ascribed to it in NRS 386.500.

(b) "Service" has the meaning ascribed to it in NRS 286.078.

2-15 Sec. 2. NRS 286.3005 is hereby amended to read as follows:

2-16 286.3005 A state agency may purchase credit for service on behalf of a

member only as provided in NRS 286.3007. Except as otherwise required as

2-17 a result of section 1 of this act or NRS 286.537, any other public employer

may pay any portion of the cost to purchase credit for service under NRS

2-18 286.300, but is not required to do so. No credit may be validated unless the

2-19 cost of purchasing credit has been paid.

Sec. 3. This act becomes effective on July 1, 1999, and applies to

2-20 employment for a school year that begins on or after July 1, 1999.
