AN ACT relating to elections; authorizing a candidate for certain elective offices to include a statement in a publication prepared by the secretary of state; establishing certain requirements regarding the information that is included in the statement; authorizing the secretary of state to adopt certain regulations; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. Chapter 293 of NRS is hereby amended by adding thereto

1-2 the provisions set forth as sections 2 and 3 of this act.

1-3 Sec. 2. 1. A candidate whose name will appear on the ballot for the

1-4 general election for the office of United States Senator or Representative

1-5 in Congress or any statewide office may prepare a statement for

1-6 inclusion in a publication to be prepared and distributed by the secretary

1-7 of state.

1-8 2. The statement:

1-9 (a) May include the name, age and occupation of the candidate and a

1-10 brief description of the education and qualifications of the candidate;

1-11 (b) Must be written on a form prescribed by the secretary of state;

1-12 (c) Must be authored by the candidate personally;

1-13 (d) Must be not more than 400 words in length; and

1-14 (e) Must not make reference to any other candidate or to the

1-15 qualifications, character or activities of any other candidate.

1-16 3. The candidate must file the statement with the filing officer with

1-17 whom he must file his declaration of candidacy or acceptance of

2-1 candidacy on or before the date that his declaration of candidacy or

2-2 acceptance of candidacy must be filed.

2-3 4. A candidate may withdraw, but not change, his statement not later

2-4 than 7 days after the date that his declaration of candidacy or acceptance

2-5 of candidacy must be filed.

2-6 5. The provisions of this section do not release a candidate from any

2-7 criminal or civil liability for any information he includes in his

2-8 statement.

2-9 6. The secretary of state may reject a statement if it is not in

2-10 conformance with the provisions of subsection 2 or the regulations

2-11 adopted by the secretary of state pursuant to section 3 of this act.

2-12 Sec. 3. The secretary of state shall adopt regulations to carry out the

2-13 provisions of this act.

2-14 Sec. 4. NRS 293.195 is hereby amended to read as follows:

2-15 293.195 1. Judicial offices, school offices, the office of county

2-16 sheriff, the board of regents of the University of Nevada, city and town

2-17 officers, the state board of education and members of boards of hospital

2-18 trustees of public hospitals are hereby designated nonpartisan offices.

2-19 2. No words designating the party affiliation of a candidate for

2-20 nonpartisan [offices] office may be printed upon the ballot.

2-21 3. No words designating the party affiliation of a candidate for

2-22 nonpartisan office may be included in a statement prepared pursuant to

2-23 section 2 of this act.
