THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. Chapter 391 of NRS is hereby amended by adding thereto a1-2
new section to read as follows:1-3
1. Except as otherwise provided in subsection 3 of this section and1-4
except as otherwise required as a result of NRS 286.537, the board of1-5
trustees of a school district shall pay the cost for a licensed teacher to1-6
purchase one-fifth of a year of service pursuant to subsection 2 of NRS1-7
286.300 if:1-8
(a) The teacher is a member of the public employees’ retirement1-9
system and has at least 5 years of service;1-10
(b) The teacher has been employed as a licensed teacher in this state1-11
for at least 5 consecutive school years, regardless of whether the1-12
employment was with one or more school districts in this state;1-13
(c) Each evaluation of the teacher conducted pursuant to NRS1-14
391.3125 is at least satisfactory for the years of employment required by1-15
paragraph (b); and2-1
(d) In addition to the years of employment required by paragraph (b),2-2
the teacher has been employed as a licensed teacher for 1 school year at a2-3
school within the school district which, for that school year, carries the2-4
designation of demonstrating inadequate achievement pursuant to NRS2-5
385.367.2-6
2. Except as otherwise provided in subsection 3, the board of trustees2-7
of a school district shall pay the cost for a licensed teacher to purchase2-8
one-fifth of a year of service for each year that a teacher is employed as a2-9
teacher at a school within the school district that is described in2-10
paragraph (d) of subsection 1.2-11
3. In no event may the years of service purchased by a licensed2-12
teacher as a result of subsection 2 of NRS 286.300 exceed 5 years.2-13
4. The board of trustees of a school district shall not:2-14
(a) Assign or reassign a licensed teacher to circumvent the2-15
requirements of this section.2-16
(b) Include, as part of a teacher’s salary, the costs of paying the2-17
teacher to purchase service pursuant to this section.2-18
5. As used in this section, "service" has the meaning ascribed to it in2-19
NRS 286.078.2-20
Sec. 2. NRS 286.3005 is hereby amended to read as follows: 286.3005 A state agency may purchase credit for service on behalf of a2-22
member only as provided in NRS 286.3007. Except as otherwise required as2-23
a result of section 1 of this act or NRS 286.537, any other public employer2-24
may pay any portion of the cost to purchase credit for service under NRS2-25
286.300, but is not required to do so. No credit may be validated unless the2-26
cost of purchasing credit has been paid.2-27
Sec. 3. This act becomes effective on July 1, 1999, and applies to2-28
employment for a school year that begins on or after July 1, 1999.~
