SENATE CONCURRENT RESOLUTION—Urging certain state agencies to use labor
provided by offenders and volunteers for the construction and maintenance of certain
facilities and projects in the Lake Tahoe Basin.

Whereas, The Lake Tahoe Basin exhibits unique environmental and1-2
ecological conditions that are irreplaceable; and1-3
Whereas, The Nevada Legislature is vitally concerned with conserving1-4
those unique environmental and ecological conditions; and1-5
Whereas, The construction and maintenance of facilities and projects1-6
necessary for the conservation of those unique environmental and1-7
ecological conditions will be highly labor-intensive; and1-8
Whereas, Public and private entities, including, without limitation, the1-9
Division of State Parks of the State Department of Conservation and1-10
Natural Resources and the League to Save Lake Tahoe, have successfully1-11
used labor provided by volunteers to carry out activities relating to1-12
conservation in the Lake Tahoe Basin; and1-13
Whereas, Some state agencies that perform activities relating to1-14
conservation in the Lake Tahoe Basin, including, without limitation, the1-15
Department of Transportation and the Divisions of Forestry, State Lands1-16
and State Parks of the State Department of Conservation and Natural1-17
Resources, have successfully used labor provided by offenders to construct1-18
and maintain facilities and projects to carry out those activities; and2-1
Whereas, The use of labor provided by offenders and volunteers to2-2
construct and maintain facilities and projects in the Lake Tahoe Basin is a2-3
method by which state agencies may carry out activities relating to2-4
conservation within their budgets; and2-5
Whereas, The Nevada Legislature has enacted laws authorizing the2-6
employment of offenders, including, without limitation, provisions2-7
requiring the Director of the Department of Prisons to contract with2-8
governmental agencies for the employment of offenders; and2-9
Whereas, The Department of Prisons and the Division of Forestry2-10
have entered into a cooperative agreement that allows offenders housed in2-11
conservation camps to perform labor related to the conservation of the2-12
natural environment; now, therefore, be it2-13
Resolved by the Senate of the State of Nevada, the Assembly2-14
Concurring, That the members of the 70th session of the Nevada2-15
Legislature hereby urge state agencies that perform activities relating to2-16
conservation in the Lake Tahoe Basin to use, to the greatest extent2-17
practicable, labor provided by offenders and volunteers to construct and2-18
maintain facilities and projects to carry out those activities; and be it2-20
Resolved, That the members of the 70th session of the Nevada2-21
Legislature hereby urge the Division of Forestry to, where practicable,2-22
provide crews composed of offenders to be dedicated exclusively to2-23
working on the construction and maintenance of facilities and projects to2-24
carry out the conservation of the unique environmental and ecological2-25
conditions exhibited in the Lake Tahoe Basin; and be it further2-26
Resolved, That any such use of labor provided by offenders to2-27
construct and maintain facilities and projects for the conservation of the2-28
unique environmental and ecological conditions exhibited in the Lake2-29
Tahoe Basin must have an insignificant effect on the number of jobs2-30
available to the residents of this state as required by NRS 209.461 for2-31
programs for the employment of offenders; and be it further2-32
Resolved, That the Secretary of the Senate prepare and transmit a2-33
copy of this resolution to the governing body of the Tahoe Regional2-34
Planning Agency, the Director of the State Department of Conservation2-35
and Natural Resources, the executive head of the Divisions of Forestry,2-36
State Lands and State Parks of the State Department of Conservation and2-37
Natural Resources, the Director and the Board of Directors of the2-38
Department of Transportation, the Director of the Department of Prisons2-39
and the Chief of the Budget Division of the Department of Administration.~
