SENATE CONCURRENT RESOLUTIONUrging certain state agencies to use labor

provided by offenders and volunteers for the construction and maintenance of certain

facilities and projects in the Lake Tahoe Basin.

1-1 Whereas, The Lake Tahoe Basin exhibits unique environmental and

1-2 ecological conditions that are irreplaceable; and

1-3 Whereas, The Nevada Legislature is vitally concerned with conserving

1-4 those unique environmental and ecological conditions; and

1-5 Whereas, The construction and maintenance of facilities and projects

1-6 necessary for the conservation of those unique environmental and

1-7 ecological conditions will be highly labor-intensive; and

1-8 Whereas, Public and private entities, including, without limitation, the

1-9 Division of State Parks of the State Department of Conservation and

1-10 Natural Resources and the League to Save Lake Tahoe, have successfully

1-11 used labor provided by volunteers to carry out activities relating to

1-12 conservation in the Lake Tahoe Basin; and

1-13 Whereas, Some state agencies that perform activities relating to

1-14 conservation in the Lake Tahoe Basin, including, without limitation, the

1-15 Department of Transportation and the Divisions of Forestry, State Lands

1-16 and State Parks of the State Department of Conservation and Natural

1-17 Resources, have successfully used labor provided by offenders to construct

1-18 and maintain facilities and projects to carry out those activities; and

2-1 Whereas, The use of labor provided by offenders and volunteers to

2-2 construct and maintain facilities and projects in the Lake Tahoe Basin is a

2-3 method by which state agencies may carry out activities relating to

2-4 conservation within their budgets; and

2-5 Whereas, The Nevada Legislature has enacted laws authorizing the

2-6 employment of offenders, including, without limitation, provisions

2-7 requiring the Director of the Department of Prisons to contract with

2-8 governmental agencies for the employment of offenders; and

2-9 Whereas, The Department of Prisons and the Division of Forestry

2-10 have entered into a cooperative agreement that allows offenders housed in

2-11 conservation camps to perform labor related to the conservation of the

2-12 natural environment; now, therefore, be it

2-13 Resolved by the Senate of the State of Nevada, the Assembly

2-14 Concurring, That the members of the 70th session of the Nevada

2-15 Legislature hereby urge state agencies that perform activities relating to

2-16 conservation in the Lake Tahoe Basin to use, to the greatest extent

2-17 practicable, labor provided by offenders and volunteers to construct and

2-18 maintain facilities and projects to carry out those activities; and be it
2-19 further

2-20 Resolved, That the members of the 70th session of the Nevada

2-21 Legislature hereby urge the Division of Forestry to, where practicable,

2-22 provide crews composed of offenders to be dedicated exclusively to

2-23 working on the construction and maintenance of facilities and projects to

2-24 carry out the conservation of the unique environmental and ecological

2-25 conditions exhibited in the Lake Tahoe Basin; and be it further

2-26 Resolved, That any such use of labor provided by offenders to

2-27 construct and maintain facilities and projects for the conservation of the

2-28 unique environmental and ecological conditions exhibited in the Lake

2-29 Tahoe Basin must have an insignificant effect on the number of jobs

2-30 available to the residents of this state as required by NRS 209.461 for

2-31 programs for the employment of offenders; and be it further

2-32 Resolved, That the Secretary of the Senate prepare and transmit a

2-33 copy of this resolution to the governing body of the Tahoe Regional

2-34 Planning Agency, the Director of the State Department of Conservation

2-35 and Natural Resources, the executive head of the Divisions of Forestry,

2-36 State Lands and State Parks of the State Department of Conservation and

2-37 Natural Resources, the Director and the Board of Directors of the

2-38 Department of Transportation, the Director of the Department of Prisons

2-39 and the Chief of the Budget Division of the Department of Administration.
