SENATE CONCURRENT RESOLUTIONDirecting the Legislative Commission to

conduct an interim study of the requirements for reapportionment and redistricting in the

State of Nevada.

1-1 Whereas, The 71st session of the Nevada Legislature will be required

1-2 to reapportion and redistrict the election districts for the members of the

1-3 Legislature, the members in the United States House of Representatives

1-4 from the State of Nevada, the Board of Regents of the University of Nevada

1-5 System and the State Board of Education; and

1-6 Whereas, The Bureau of the Census of the United States Department of

1-7 Commerce is required to deliver redistricting data from the decennial census

1-8 in 2000 to the states not later than April 1, 2001, when the Nevada

1-9 Legislature already will be in session; and

1-10 Whereas, The amount of data from the census in 2000 and the necessity

1-11 to accomplish reapportionment and redistricting in an expeditious manner

1-12 during the 71st legislative session will require additional computer software

1-13 and extensive preparation and testing to allow for the generation and

1-14 analysis of proposals concerning reapportionment and redistricting; and

1-15 Whereas, The reapportionment and redistricting must comply with

1-16 current case law and constitutional and statutory legal requirements; and

1-17 Whereas, The Nevada Legislature has been working with the Bureau of

1-18 the Census on the Block Boundary Suggestion Program and other programs

1-19 in preparation for the census in 2000 and the process of reapportionment

1-20 and redistricting; now, therefore, be it

2-1 Resolved by the Senate of the State of Nevada, the Assembly

2-2 Concurring, That the Legislative Commission is hereby directed to study

2-3 the requirements for reapportionment and redistricting in this state in

2-4 conjunction with the data from the decennial census of 2000; and be it

2-5 further

2-6 Resolved, That the committee to conduct the study consists of eight

2-7 members of the 70th Legislative Session to be appointed as follows:

2-8 1. Three members of the Senate appointed by the Majority Leader of

2-9 the Senate.

2-10 2. One member of the Senate appointed by the Minority Leader of the

2-11 Senate.

2-12 3. Three members of the Assembly appointed by the Speaker of the

2-13 Assembly.

2-14 4. One member of the Assembly appointed by the Minority Leader of

2-15 the Assembly.

2-16 The Legislative Commission shall appoint the chairman of the committee;

2-17 and be it further

2-18 Resolved, That the study include:

2-19 1. A continuing examination and monitoring of any redistricting

2-20 systems established or recommended by the 70th session of the Nevada

2-21 Legislature, or to be established pursuant to any legislation enacted by the

2-22 70th session of the Nevada Legislature, including the requirements for

2-23 computer equipment, computer software and the training of personnel;

2-24 2. A review of the case law concerning the legal requirements for

2-25 reapportionment and redistricting;

2-26 3. A review of the programs concerning planning for reapportionment

2-27 and redistricting in other states;

2-28 4. The continuation of the state’s participation in the programs of the

2-29 Bureau of the Census; and

2-30 5. The participation in a program of the Bureau of the Census to

2-31 increase the awareness of the general public concerning the census to ensure

2-32 a complete and accurate count of all Nevadans in the year 2000; and be it

2-33 further

2-34 Resolved, That the Legislative Commission may enter into contracts or

2-35 other necessary agreements to establish and test reapportionment and

2-36 redistricting programs and computer equipment to provide for the timely

2-37 and efficient commencement of data processing for reapportionment and

2-38 redistricting before the legislature convenes in 2001; and be it further

2-39 Resolved, That no action may be taken by the study committee on

2-40 recommended legislation unless it receives a majority vote of the Senators

2-41 on the committee and a majority vote of the Assemblymen on the

2-42 committee; and be it further

3-1 Resolved, That the Legislative Commission report to the 71st session of

3-2 the Nevada Legislature the results of the study and any action taken in

3-3 preparation for and any recommendations concerning reapportionment and

3-4 redistricting.
