SENATE CONCURRENT RESOLUTION—Directing the Legislative Commission to
conduct an interim study of the requirements for reapportionment and redistricting in the
State of Nevada.

Whereas, The 71st session of the Nevada Legislature will be required1-2
to reapportion and redistrict the election districts for the members of the1-3
Legislature, the members in the United States House of Representatives1-4
from the State of Nevada, the Board of Regents of the University of Nevada1-5
System and the State Board of Education; and1-6
Whereas, The Bureau of the Census of the United States Department of1-7
Commerce is required to deliver redistricting data from the decennial census1-8
in 2000 to the states not later than April 1, 2001, when the Nevada1-9
Legislature already will be in session; and1-10
Whereas, The amount of data from the census in 2000 and the necessity1-11
to accomplish reapportionment and redistricting in an expeditious manner1-12
during the 71st legislative session will require additional computer software1-13
and extensive preparation and testing to allow for the generation and1-14
analysis of proposals concerning reapportionment and redistricting; and1-15
Whereas, The reapportionment and redistricting must comply with1-16
current case law and constitutional and statutory legal requirements; and1-17
Whereas, The Nevada Legislature has been working with the Bureau of1-18
the Census on the Block Boundary Suggestion Program and other programs1-19
in preparation for the census in 2000 and the process of reapportionment1-20
and redistricting; now, therefore, be it2-1
Resolved by the Senate of the State of Nevada, the Assembly2-2
Concurring, That the Legislative Commission is hereby directed to study2-3
the requirements for reapportionment and redistricting in this state in2-4
conjunction with the data from the decennial census of 2000; and be it2-5
further2-6
Resolved, That the committee to conduct the study consists of eight2-7
members of the 70th Legislative Session to be appointed, subject to the2-8
approval of the Legislative Commission, as follows:2-9
1. Three members of the Senate appointed by the Majority Leader of2-10
the Senate.2-11
2. One member of the Senate appointed by the Minority Leader of the2-12
Senate.2-13
3. Three members of the Assembly appointed by the Speaker of the2-14
Assembly.2-15
4. One member of the Assembly appointed by the Minority Leader of2-16
the Assembly.2-17
The Legislative Commission shall appoint the chairman of the committee2-18
and, in approving the appointments to the committee, shall ensure that not2-19
less than two of the members are appointed from the Assembly Standing2-20
Committee on Elections, Procedures, and Ethics and not less than two of the2-21
members are appointed from the Senate Standing Committee on2-22
Government Affairs; and be it further2-23
Resolved, That the study include:2-24
1. A continuing examination and monitoring of any redistricting2-25
systems established or recommended by the 70th session of the Nevada2-26
Legislature, or to be established pursuant to any legislation enacted by the2-27
70th session of the Nevada Legislature, including the requirements for2-28
computer equipment, computer software and the training of personnel;2-29
2. A review of the case law concerning the legal requirements for2-30
reapportionment and redistricting;2-31
3. A review of the programs concerning planning for reapportionment2-32
and redistricting in other states;2-33
4. The continuation of the state’s participation in the programs of the2-34
Bureau of the Census; and2-35
5. The participation in a program of the Bureau of the Census to2-36
increase the awareness of the general public concerning the census to ensure2-37
a complete and accurate count of all Nevadans in the year 2000; and be it2-38
further2-39
Resolved, That the Legislative Commission may enter into contracts or2-40
other necessary agreements to establish and test reapportionment and2-41
redistricting programs and computer equipment to provide for the timely2-42
and efficient commencement of data processing for reapportionment and2-43
redistricting before the legislature convenes in 2001; and be it further3-1
Resolved, That no action may be taken by the study committee on3-2
recommended legislation unless it receives a majority vote of the Senators3-3
on the committee and a majority vote of the Assemblymen on the3-4
committee; and be it further3-5
Resolved, That the Legislative Commission report to the 71st session of3-6
the Nevada Legislature the results of the study and any action taken in3-7
preparation for and any recommendations concerning reapportionment and3-8
redistricting.~
