SENATE CONCURRENT RESOLUTIONDirecting the Legislative Commission to

conduct an interim study of the causes and possible solutions to air pollution in Clark County.

1-1 Whereas, Rapid population growth and an increase in tourism have

1-2 inundated the Las Vegas Valley in recent years; and

1-3 Whereas, The Las Vegas Valley has been declared a serious

1-4 nonattainment area for dust particle and carbon monoxide pollution by the

1-5 Environmental Protection Agency; and

1-6 Whereas, Clark County is currently under restriction by the

1-7 Environmental Protection Agency that excessive levels of carbon

1-8 monoxide must not be detected on more than 1 day for each of the next 2

1-9 years or sanctions such as loss of federal highway money and federally

1-10 mandated car pooling and restrictions on growth may be imposed; and

1-11 Whereas, Carbon monoxide levels are considered "unhealthy" when

1-12 they reach 100 parts per million on the pollution index and "excessive"

1-13 when they reach 113 parts or more per million; and

1-14 Whereas, Clark County exceeded the "unhealthy" standard three times

1-15 in 1998, with two of those times exceeding the 113-level mark; and

1-16 Whereas, Carbon monoxide at unhealthy levels robs the body of

1-17 oxygen, causing fatigue and headaches, and more serious symptoms for

1-18 people with respiratory problems; now, therefore, be it

1-19 Resolved by the Senate of the State of Nevada, the Assembly

1-20 Concurring, That the Legislative Commission is hereby directed to

1-21 appoint an interim committee, composed of members of the Assembly and

1-22 members of the Senate, to conduct an interim study concerning the causes

1-23 and possible solutions to the problem of air pollution in Clark County; and

1-24 be it further

2-1 Resolved, That the study include, without limitation, an examination,

2-2 review and evaluation of:

2-3 1. The types and rates of success of programs used in other states or

2-4 counties to combat air pollution;

2-5 2. The regulations of this state and other states that are designed to

2-6 combat the problem of air pollution;

2-7 3. Viable means of reducing carbon monoxide levels, including,

2-8 without limitation, stricter smog checks, annual smog checks on diesel

2-9 trucks and buses, and the use of 3.5 percent oxygenated fuel either during

2-10 the winter or year-round; and

2-11 4. The feasibility of implementing such programs; and be it further

2-12 Resolved, That any recommended legislation proposed by the

2-13 committee must be approved by a majority of the members of the

2-14 Assembly appointed to the committee and a majority of the members of

2-15 the Senate appointed to the committee; and be it further

2-16 Resolved, That the Legislative Commission submit a report of the

2-17 results of the study and any recommended legislation to the 71st session of

2-18 the Nevada Legislature.
