1-1 Whereas, On October 19, 1998, the Southern Nevada Public Land

1-2 Management Act of 1998 was enacted by Congress as Public Law 105-

1-3 263; and

1-4 Whereas, Pursuant to that act, the Secretary of the Interior is required

1-5 to dispose of public lands under his jurisdiction that are designated for that

1-6 purpose in Clark County, Nevada; and

1-7 Whereas, Pursuant to the act, the State of Nevada or certain local

1-8 governments of this state specified in the act may elect to obtain any of

1-9 those lands for local public purposes pursuant to the Recreation and Public

1-10 Purposes Act, 43 U.S.C. §§ 869 et seq.; and

1-11 Whereas, Pursuant to the act, a portion of the gross receipts from any

1-12 sales of public lands made during a fiscal year must be paid directly to the

1-13 State of Nevada for use in the general education program of this state and

1-14 to the Southern Nevada Water Authority for the treatment of water and for

1-15 infrastructure for facilities to transmit water in Clark County, Nevada; and

1-16 Whereas, Pursuant to the act, the remainder of the proceeds must be

1-17 deposited into a special account in the Treasury of the United States for use

1-18 by the Secretary of the Interior:

2-1 1. To acquire environmentally sensitive land in this state as defined in

2-2 the act;

2-3 2. For capital improvements for certain recreation and conservation

2-4 areas and wildlife refuges specified in the act;

2-5 3. To develop a multispecies habitat conservation plan in Clark

2-6 County, Nevada;

2-7 4. To develop parks, trails and natural areas in Clark County; and

2-8 5. To reimburse a local office of the Bureau of Land Management for

2-9 any costs incurred by the office in arranging sales or exchanges of land

2-10 pursuant to the act; now, therefore, be it

2-11 Resolved by the Senate and Assembly of the State of Nevada,

2-12 Jointly, That the Legislature of the State of Nevada urges the members

2-13 of the Nevada Congressional Delegation to introduce and support

2-14 legislation that:

2-15 1. Applies to any public lands in this state that:

2-16 (a) Are identified for disposal on resource management plans and

2-17 management framework plans compiled by the United States Bureau of

2-18 Land Management; and

2-19 (b) Are not included in the provisions of the Southern Nevada Public

2-20 Land Management Act of 1998; and

2-21 2. Provides for the identification and disposal of those public lands in

2-22 a manner similar to the manner provided for the identification and disposal

2-23 of public lands set forth in that act; and be it further

2-24 Resolved, That the legislation include provisions for the payment of a

2-25 portion of the gross receipts from any sales of public lands made pursuant

2-26 to the legislation to:

2-27 1. The State of Nevada for general education programs in this state;

2-28 2. Local governments in this state for infrastructure and for the

2-29 adoption or amendment of any plan for the use of land, regulations

2-30 concerning zoning or other actions relating to planning required by a local

2-31 government because of a sale or other disposal of public lands pursuant to

2-32 the legislation;

2-33 3. The Secretary of the Interior for any purpose specified in the

2-34 legislation that is consistent with the plans for the management of public

2-35 lands adopted by the Bureau of Land Management that apply to public

2-36 lands remaining under the management or control of the Federal

2-37 Government pursuant to the legislation; and

2-38 4. The Secretary of Agriculture for the acquisition of environmentally

2-39 sensitive land in the Lake Tahoe Basin and other programs and projects

2-40 that will promote and protect the quality of the environment in the basin;

2-41 and be it further

3-1 Resolved, That the Secretary of the Senate prepare and transmit a

3-2 copy of this resolution to each member of the Nevada Congressional

3-3 Delegation; and be it further

3-4 Resolved, That this resolution becomes effective upon passage and

3-5 approval.
