SENATE JOINT RESOLUTION—Urging the members of the Nevada Congressional
Delegation to introduce and support legislation providing for the disposal of certain public
lands in this state.

Whereas, On October 19, 1998, the Southern Nevada Public Land1-2
Management Act of 1998 was enacted by Congress as Public Law 105-1-3
263; and1-4
Whereas, Pursuant to that act, the Secretary of the Interior is required1-5
to dispose of public lands under his jurisdiction that are designated for that1-6
purpose in Clark County, Nevada; and1-7
Whereas, Pursuant to the act, the State of Nevada or certain local1-8
governments of this state specified in the act may elect to obtain any of1-9
those lands for local public purposes pursuant to the Recreation and Public1-10
Purposes Act, 43 U.S.C. §§ 869 et seq.; and1-11
Whereas, Pursuant to the act, a portion of the gross receipts from any1-12
sales of public lands made during a fiscal year must be paid directly to the1-13
State of Nevada for use in the general education program of this state and1-14
to the Southern Nevada Water Authority for the treatment of water and for1-15
infrastructure for facilities to transmit water in Clark County, Nevada; and1-16
Whereas, Pursuant to the act, the remainder of the proceeds must be1-17
deposited into a special account in the Treasury of the United States for use1-18
by the Secretary of the Interior:2-1
1. To acquire environmentally sensitive land in this state as defined in2-2
the act;2-3
2. For capital improvements for certain recreation and conservation2-4
areas and wildlife refuges specified in the act;2-5
3. To develop a multispecies habitat conservation plan in Clark2-6
County, Nevada;2-7
4. To develop parks, trails and natural areas in Clark County; and2-8
5. To reimburse a local office of the Bureau of Land Management for2-9
any costs incurred by the office in arranging sales or exchanges of land2-10
pursuant to the act; now, therefore, be it2-11
Resolved by the Senate and Assembly of the State of Nevada,2-12
Jointly, That the Legislature of the State of Nevada urges the members2-13
of the Nevada Congressional Delegation to introduce and support2-14
legislation that:2-15
1. Applies to any public lands in this state that:2-16
(a) Are identified for disposal on resource management plans and2-17
management framework plans compiled by the United States Bureau of2-18
Land Management; and2-19
(b) Are not included in the provisions of the Southern Nevada Public2-20
Land Management Act of 1998; and2-21
2. Provides for the identification and disposal of those public lands in2-22
a manner similar to the manner provided for the identification and disposal2-23
of public lands set forth in that act; and be it further2-24
Resolved, That the legislation include provisions for the payment of a2-25
portion of the gross receipts from any sales of public lands made pursuant2-26
to the legislation to:2-27
1. The State of Nevada for general education programs in this state;2-28
2. Local governments in this state for infrastructure and for the2-29
adoption or amendment of any plan for the use of land, regulations2-30
concerning zoning or other actions relating to planning required by a local2-31
government because of a sale or other disposal of public lands pursuant to2-32
the legislation;2-33
3. The Secretary of the Interior for any purpose specified in the2-34
legislation that is consistent with the plans for the management of public2-35
lands adopted by the Bureau of Land Management that apply to public2-36
lands remaining under the management or control of the Federal2-37
Government pursuant to the legislation; and2-38
4. The Secretary of Agriculture for the acquisition of environmentally2-39
sensitive land in the Lake Tahoe Basin and other programs and projects2-40
that will promote and protect the quality of the environment in the basin;2-41
and be it further3-1
Resolved, That the Secretary of the Senate prepare and transmit a3-2
copy of this resolution to each member of the Nevada Congressional3-3
Delegation; and be it further3-4
Resolved, That this resolution becomes effective upon passage and3-5
approval.~
