SENATE JOINT RESOLUTIONProposing to amend the Constitution of the State of

Nevada to provide that the state controller is appointed by and serves at the pleasure of the

governor.

1-1 Resolved by the Senate and Assembly of the State of Nevada,

1-2 Jointly, That section 19 of article 5 of the Constitution of the State of

1-3 Nevada be amended to read as follows:

1-4 Sec. 19. 1. A secretary of state, a treasurer, [a controller,] and an

1-5 attorney general, shall be elected at the same time and places, and in the

1-6 same manner as the governor. The term of office of each shall be the same

1-7 as is prescribed for the governor.

1-8 2. Any elector shall be eligible to any of these offices, but no person

1-9 may be elected to any of them more than twice, or more than once if he has

1-10 previously held the office by election or appointment.

1-11 3. The governor shall appoint a state controller. The controller

1-12 serves at the pleasure of the governor. The legislature may prescribe by

1-13 law the qualifications and duties of the state controller.

1-14 And be it further

1-15 Resolved, That the amendment made to section 19 of article 5 of the

1-16 Constitution of the State of Nevada by this resolution becomes effective on

1-17 November 27, 2002, if it is approved by the voters at the general election

1-18 on November 4, 2002. Notwithstanding the amendatory provisions of this

1-19 resolution, the term of office of the controller elected at the general

1-20 election in 2002, expires on December 31, 2006, unless the person so

1-21 elected

2-1 vacates the office before December 31, 2006. If the person elected to the

2-2 office of the controller at the general election in 2002, vacates the office

2-3 before December 31, 2006, the governor shall, as soon as practicable,

2-4 appoint a state controller.
