The Subcommittee on Commerce and Labor was called to order at 1:09 p.m. on Thursday, May 17, 2001. Chairman Sheila Leslie presided in Room 3142 of the Legislative Building, Carson City, Nevada. Exhibit A is the Agenda. Exhibit B is the Guest List. All exhibits are available and on file at the Research Library of the Legislative Counsel Bureau.

Chairman Leslie called the meeting to order and all subcommittee members were present. The subcommittee took up S.B. 418.
Senate Bill 418: Makes various changes to provisions governing sale of real property. (BDR 54-159)
Patrick Coward, Legislative Representative, Nevada Association of Realtors, told the subcommittee the Nevada Trial Lawyers and the realtors had come together on amendment language for S.B. 418, and he provided the committee with a document outlining the proposed amendments (Exhibit C). He noted there was concern that the original language of the bill was too broad and a statement was added on page 2 to narrow the language. Mr. Coward indicated Section 2, subsection 4, and Section 3, subsection (a), were removed because the parties could not come to an agreement on the language. He noted a new subsection (c) was added to Section 3, which relieved a licensee from duties imposed on the licensee under Nevada Revised Statute (NRS) 645.252(1)(a) and it was further noted the remaining subsections would need to be renumbered. Mr. Coward noted language was eliminated in Section 7 and the number “5” was removed from Section 8, subsection 1 and placed in subsection 2. He stated Sections 4 and 5 would become effective on July 1, 2002 to allow the division ample time to make the computer change to accommodate the training schedule. Mr. Coward noted a provision had been included in the bill that would split the license fee for a new real estate agent or broker.
Victoria Riley, Legislative Representative, Nevada Trial Lawyers Association, confirmed that, with the changes outlined by Mr. Coward, both parties were comfortable with S.B. 418.
Ms. Giunchigliani clarified that both Sections 4 and 5 would become effective on July 1, 2002.
ASSEMBLYMAN HUMKE MOVED THE SUBCOMMITTEE MAKE THE RECOMMENDATION OF AMEND AND DO PASS S.B. 418 TO THE FULL COMMITTEE.
ASSEMBLYWOMAN GIUNCHIGLIANI SECONDED THE MOTION.
THE MOTION PASSED UNANIMOUSLY BY THOSE PRESENT.
There being no further business to come before the subcommittee, Chairman Leslie adjourned the meeting at 1:15 p.m.
