The Subcommittee on Judiciarywas called to order at 10:04 a.m., on Tuesday, April 3, 2001. Chairman Bernie Anderson presided in Room 3138 of the Legislative Building, Carson City, Nevada.

Chairman Anderson convened the subcommittee on Judiciary on A.B. 34.
Assembly Bill 34: Revises provisions governing granting of rights to visitation with child to persons other than parents of child. (BDR 11-193)
Chairman Anderson indicated Risa Lang, Committee Counsel, prepared a proposed amendment on behalf of the subcommittee, which added language putting the district court in the county in which the child resided. He further indicated a party could seek a reasonable right to visit the child during his minority. The words “clear and convincing evidence” would be replaced with the words “preponderance of evidence,” and the recommendation “will suffer harm if a right to visit is not granted to the party” would be replaced by the language “in determining whether the presumption has been rebutted, the court may consider evidence presented by the parent of the child that it is not in the best interest of the child to grant visitation.” Chairman Anderson noted the changes agreed to in substance at the last subcommittee meeting would also be made to the bill.
ASSEMBLYWOMAN BUCKLEY MOVED FOR COMMITTEE RECOMMENDATION OF THE PROPOSED AMENDMENTS.
ASSEMBLYMAN CARPENTER SECONDED THE MOTION.
THE MOTION PASSED UNANIMOUSLY.
There being no further business to come before the subcommittee, the meeting was adjourned at 10:06 a.m.
