The Senate Committee on Legislative Affairs and Operationswas called to order by Chairman Jon C. Porter, at 8:00 p.m., on Sunday, June 3, 2001, on the Senate Floor of the Legislative Building, Carson City, Nevada.  There was no Agenda.  There was no Attendance Roster.

Senator Porter said the committee needed to make some decisions on the proposed interim studies, and to consider the amendment the Assembly suggested to Senate Bill (S.B.) 570

 

SENATE BILL 570:  Makes various changes relating to legislature and legislative counsel bureau.  (BDR 17-1073)

 

Lorne J. Malkiewich, Director, Legislative Counsel Bureau, explained to the committee that Amendment No. 1115 made some minor changes to S.B. 570.  In section 4, page 3, line 25, the amendment deletes “10” and inserts “5.”  He said the same change is also on line 32; and in section 4, line 35, the amendment deletes “Measure” and inserts “Except as otherwise provided in [Nevada Revised Statutes] NRS 218.635, measures.”  Mr. Malkiewich said there are a few other minor changes that do not change the substance of the bill.

 

SENATOR RAGGIO MOVED TO CONCUR WITH AMENDMENT NO. 1115 TO S.B. 570.

Robert E. Erickson, Research Director, Research Division, Legislative Counsel Bureau, said the remaining bills were listed in the handout (Exhibit A), along with the amendment suggestions of the committee during the hearing of each bill.

 

Mr. Erickson said the amendment the committee discussed during the hearing on Senate Concurrent Resolution (S.C.R.) 3 added the language to allow the study of co-occurring disorders to the study of suicide.

 

SENATE CONCURRENT RESOLUTION 3:  Directs Legislative Commission to appoint interim committee to study problem of suicide and feasibility of creating statewide strategy to prevent suicide.  (BDR R-649)

 

SENATOR TITUS MOVED TO AMEND AND ADOPT AS AMENDED WITH AMENDMENT NO. 1245 TO S.C.R. 3.

Senator Porter said the proposed amendment for S.C.R. 5 would combine S.C.R. 5 and S.C.R. 6, and delete the word “Commission” and insert “Committee on Public Lands.” 

 

SENATE CONCURRENT RESOLUTION 5:  Directs Legislative Commission to conduct interim study of quality and quantity of ground water within State of Nevada.  (BDR R-310)

 

SENATE CONCURRENT RESOLUTION 6:  Directs Legislative Commission to conduct interim study concerning wilderness areas and wilderness study areas in this state.  (BDR R-727)

 

Senator Rawson asked whether S.C.R. 8 could also be given to the Legislative Committee on Public Lands.

 

SENATE CONCURRENT RESOLUTION 8:  Directs Legislative Commission to conduct interim study relating to establishment, use and maintenance of certain roads in this state.  (BDR R-728)

 

Senator Titus said that sounded like an excellent way to carry out the study of Nevada’s roads.

 

SENATOR JAMES MOVED TO AMEND AND ADOPT AS AMENDED WITH AMENDMENT NO. 1246 TO S.C.R. 5.

Mr. Erickson explained the proposed amendment to S.C.R. 9 would direct the Nevada Department of Transportation to do a study of the highway between Mesquite and Caliente.

 

SENATE CONCURRENT RESOLUTION 9:  Directs Legislative Commission to conduct interim study of feasibility of constructing highway between Mesquite and Caliente.  (BDR R-739)

 

SENATOR RAWSON MOVED TO AMEND AND ADOPT AS AMENDED WITH AMENDMENT NO. 1249 TO S.C.R. 9.

 

SENATOR WIENER SECONDED THE MOTION.

Senator Porter explained Assembly Concurrent Resolution (A.C.R.) 5 allows the continuance of the Legislative Commission’s review of the Tahoe Regional Planning Compact.  He said Nevada has a lot of money invested in the Tahoe project and it would be a good idea if Nevada continued to be an active part of the planning.

 

ASSEMBLY CONCURRENT RESOLUTION 5:  Directs Legislative Commission to appoint committee to continue review of Tahoe Regional Planning Compact.  (BDR R-703)

 

SENATOR JAMES MOVED TO ADOPT A.C.R. 5.

Senator Porter said that S.C.R. 32 was an important study; however, it needed some language changes.

 

SENATE CONCURRENT RESOLUTION 32:  Directs Legislative Commission to conduct interim study concerning Nevada’s program for providing services to persons with disabilities.  (BDR R-937)

 

SENATOR TITUS MOVED TO AMEND AND ADOPT AS AMENDED WITH AMENDMENT NO. 1268 TO S.C.R. 32.

SENATE BILL 141:  Requires study of State Fire Marshal Division of Department of Public Safety.  (BDR S-404)

Senator Porter said S.B. 355 was another of the studies the committee had indicated it wanted done during the interim.  He said the committee needed to decide whether to amend the bill with the suggestion of adding the provision to ascertain whether public facilities that were competing with private companies were doing so according to the regulations.

 

SENATE BILL 355:  Directs Legislative Commission to conduct interim study of competition between local governments and private enterprises in provision of certain goods or services.  (BDR S-49)

Senator Porter said S.B. 86 is the study about school police.  He said the suggested amendment would direct the Legislative Committee on Criminal Justice, which was established by S.B. 286, to do the study and report their findings to the Legislature as a whole.

 

SENATE BILL 86:  Directs the Legislative Commission to conduct interim study concerning use of police powers on public school grounds and at school activities.  (BDR S‑823)

           

SENATE BILL 286Revises provisions relating to certain committees that review issues pertaining to criminal justice.  (BDR 14-774)

 

SENATOR JAMES MOVED TO AMEND AND DO PASS AS AMENDED WITH AMENDMENT NO. 1241 TO S.B. 86.

 

SENATOR MATHEWS SECONDED THE MOTION.

Mr. Erickson said the proposed amendment to S.B. 305 is outlined in Exhibit A.

 

SENATE BILL 305:  Requires Legislative Commission to appoint committee to conduct interim study of and disseminate information regarding programs for certain at‑risk pupils.  (BDR S-263)

 

SENATOR RAWSON MOVED TO AMEND AND DO PASS AS AMENDED WITH AMENDMENT NO. 1243 TO S.B. 305.

Senator Raggio asked whether the study in S.C.R. 50 could be referred to the Legislative Committee on Health.

 

Senator Rawson replied that the health committee could probably do the study.

 

SENATE CONCURRENT RESOLUTION 50:  Directs Legislative Commission to conduct interim study of certain systems that offer health benefits provided by various governmental employers.  (BDR R-1549)

 

SENATOR RAWSON MOVED TO AMEND AND ADOPT AS AMENDED WITH AMENDMENT NO. 1251 TO S.C.R. 50.
