AN ACT relating to cities; requiring the inclusion of certain portions of county roads,
state highways and railroads in territory annexed by cities in larger counties;
and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 268
of NRS is hereby amended by adding thereto a
1-2 new section to read as
follows:
1-3 If a city annexes territory which is not included within its
existing
1-4 boundaries, the territory annexed includes the following:
1-5 1. If the annexed territory abuts upon one side
of a county road, state
1-6 highway or railroad and the territory which abuts upon the opposite
side
1-7 of the road, highway or railroad is not within the boundaries of
the
1-8 annexing city, the annexed territory extends to the middle of the
road,
1-9 highway or railroad. The governing body of a city may annex the
1-10 remaining portion of the road, highway or railroad, and that
portion of
1-11 any county road which is then included in the annexed territory
becomes
1-12 a city street.
1-13 2. If the annexed territory abuts upon a county
road, state highway
1-14 or railroad on both sides of the road, highway or railroad, or if
the
1-15 annexed territory abuts upon one side of a county road, state highway
or
1-16 railroad and the territory which abuts upon the opposite side of
the road,
1-17 highway or railroad is within the existing boundaries of the
annexing
1-18 city, the annexed territory includes the portion of road, highway
or
1-19 railroad so abutted on both sides, and that portion of any county
road
1-20 which is then included in the annexed territory becomes a city
street.
2-1 3. If the annexed territory is a subdivision,
the portions of the county
2-2 roads which provide the primary access to the subdivision are also
2-3 annexed and become city streets.
2-4 Sec. 2. NRS 268.570 is hereby amended to read as
follows:
2-5 268.570 The provisions of
NRS 268.570 to 268.608, inclusive,
and
2-6 section 1 of this act, apply only to cities located in a county whose
2-7 population is 400,000 or
more.
2-8 Sec. 3. NRS 268.597 is hereby amended to read as follows:
2-9 268.597 As an alternative
to the procedures for annexation set forth in
2-10 NRS 268.578 to 268.596,
inclusive, the governing body of a city may ,
2-11 subject to the provisions of section 1 of this act, annex territory which
2-12 meets the requirements of
subsection 2 of NRS 268.580 if all of the owners
2-13 of record of individual lots
or parcels of land within the area sign a petition
2-14 requesting the governing
body to annex the area to the city. If the petition
2-15 is accepted by the governing
body, the governing body may proceed to
2-16 adopt an ordinance annexing
the area and to take such other action as is
2-17 appropriate to accomplish
the annexation.
