AN ACT relating to motor vehicles; providing for the issuance of special license plates
for the support of rodeos, including support for the programs and activities of
the Reno Rodeo Foundation and Nevada High School Rodeo Association or their
successors; imposing a fee for the issuance or renewal of such license plates;
and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 482 of NRS is hereby amended by adding
thereto a
1-2 new section to read as
follows:
1-3 1. Except as otherwise provided in this
subsection, the department, in
1-4 cooperation with the Reno Rodeo Foundation and the Nevada High
1-5 School Rodeo Association or their successors, shall design, prepare
and
1-6 issue license plates for the support of rodeos, including support
for the
1-7 programs and charitable activities of the Reno Rodeo Foundation and
1-8 the Nevada High School Rodeo Association, or their successors,
using
1-9 any colors and designs that the department deems appropriate. The
1-10 department shall not design, prepare or issue the license plates
unless it
1-11 receives at least 250 applications for the issuance of those
plates.
1-12 2. If the department receives at least 250
applications for the
1-13 issuance of license plates for the support of rodeos, the
department shall
1-14 issue those plates for a passenger car or light commercial vehicle
upon
1-15 application by a person who is entitled to license plates pursuant
to NRS
1-16 482.265 and who otherwise complies with the requirements for
1-17 registration and licensing pursuant to this chapter. A person may
request
2-1 that personalized prestige license plates issued pursuant to NRS
482.3667
2-2 be combined with license plates for the support of rodeos if that
person
2-3 pays the fees for the personalized prestige license plates in
addition to the
2-4 fees for the license plates for the support of rodeos pursuant to
2-5 subsections 3 and 4.
2-6 3. The fee for license plates for the support of
rodeos is $35, in
2-7 addition to all other applicable registration and license fees and
motor
2-8 vehicle privilege taxes. The license plates are renewable upon the
2-9 payment of $10.
2-10 4. In addition to all other applicable
registration and license fees and
2-11 motor vehicle privilege taxes and the fee prescribed in subsection
3, a
2-12 person who requests a set of license plates for the support of
rodeos must
2-13 pay for the initial issuance of the plates an additional fee of $25
and for
2-14 each renewal of the plates an additional fee of $20, to be
distributed
2-15 pursuant to subsection 5.
2-16 5. The department shall deposit the fees
collected pursuant to
2-17 subsection 4 with the state treasurer for credit to the state
general fund.
2-18 The state treasurer shall, on a quarterly basis, distribute the
fees
2-19 deposited pursuant to this subsection in the following manner:
2-20 (a) Remit one-half of the
fees to the Reno Rodeo Foundation or its
2-21 successor for the support of programs and charitable activities of
the
2-22 Reno Rodeo Foundation or its successor.
2-23 (b) Remit one-half of the
fees to the Nevada High School Rodeo
2-24 Association or its successor for the support of programs and
charitable
2-25 activities of the Nevada High School Rodeo Association or its
successor.
2-26 6. If, during a registration year, the holder of
license plates issued
2-27 pursuant to the provisions of this section disposes of the vehicle
to which
2-28 the plates are affixed, the holder shall:
2-29 (a) Retain the plates and
affix them to another vehicle that meets the
2-30 requirements of this section if the transfer and registration fees
are paid
2-31 as set forth in this chapter; or
2-32 (b) Within 30 days after
removing the plates from the vehicle, return
2-33 them to the department.
2-34 Sec. 2. NRS 482.216 is hereby amended to read as follows:
2-35 482.216 1. Upon the request of a new vehicle dealer, the
department
2-36 may authorize the new
vehicle dealer to:
2-37 (a) Accept applications for the registration of the new motor
vehicles he
2-38 sells and the related fees
and taxes;
2-39 (b) Issue certificates of registration to applicants who satisfy
the
2-40 requirements of this
chapter; and
2-41 (c) Accept applications for the transfer of registration pursuant
to NRS
2-42 482.399 if the applicant
purchased from the new vehicle dealer a new
2-43 vehicle to which the
registration is to be transferred.
2-44 2. A new vehicle dealer who
is authorized to issue certificates of
2-45 registration pursuant to
subsection 1 shall:
2-46 (a) Transmit the applications he receives to the department within
the
2-47 period prescribed by the
department;
2-48 (b) Transmit the fees he collects from the applicants and properly
2-49 account for them within the
period prescribed by the department;
3-1 (c) Comply with the regulations adopted pursuant to subsection 4;
and
3-2 (d) Bear any cost of equipment which is necessary to issue
certificates
3-3 of registration, including
any computer hardware or software.
3-4 3. A new vehicle dealer who
is authorized to issue certificates of
3-5 registration pursuant to
subsection 1 shall not:
3-6 (a) Charge any additional fee for the performance of those
services;
3-7 (b) Receive compensation from the department for the performance of
3-8 those services;
3-9 (c) Accept applications for the renewal of registration of a motor
3-10 vehicle; or
3-11 (d) Accept an application for the registration of a motor vehicle
if the
3-12 applicant wishes to:
3-13 (1) Obtain special license plates pursuant to NRS 482.3667 to
3-14 482.3825, inclusive [;] , and section 1 of this act;
or
3-15 (2) Claim the exemption from the vehicle privilege tax provided
3-16 pursuant to NRS 361.1565 to
veterans and their relations.
3-17 4. The director shall adopt
such regulations as are necessary to carry
3-18 out the provisions of this
section. The regulations adopted pursuant to this
3-19 subsection must provide for:
3-20 (a) The expedient and secure issuance of license plates and decals
by
3-21 the department; and
3-22 (b) The withdrawal of the authority granted to a new vehicle dealer
3-23 pursuant to subsection 1 if
that dealer fails to comply with the regulations
3-24 adopted by the department.
3-25 Sec. 3. NRS 482.500 is hereby amended to read as follows:
3-26 482.500 1. Except as otherwise provided in subsection 2
or 3,
3-27 whenever upon application
any duplicate or substitute certificate of
3-28 registration, decal or
number plate is issued, the following fees must be
3-29 paid:
3-30 For a certificate of registration... $5.00
3-31 For every substitute number plate or set of plates.................................... 5.00
3-32 For every duplicate number plate or set of plates.................................. 10.00
3-33 For every decal displaying a county name.............................................. .50
3-34 For every other decal, license plate sticker or tab.................................. 5.00
3-35 2. The following fees must
be paid for any replacement plate or set of
3-36 plates issued for the
following special license plates:
3-37 (a) For any special plate issued pursuant to NRS 482.3667,
482.3672,
3-38 482.3675, 482.370 to
482.376, inclusive, or 482.379 to 482.3816,
3-39 inclusive, and section 1 of this act, a
fee of $10.
3-40 (b) For any special plate issued pursuant to NRS 482.368, 482.3765,
3-41 482.377 or 482.378, a fee of
$5.
3-42 (c) For any souvenir license plate issued pursuant to NRS 482.3825
or
3-43 sample license plate issued
pursuant to NRS 482.2703, a fee equal to that
3-44 established by the director
for the issuance of those plates.
3-45 3. A fee must not be
charged for a duplicate or substitute of a decal
3-46 [requested] issued pursuant to NRS 482.37635.
4-1 4. The fees which are paid
for duplicate number plates and decals
4-2 displaying county names must
be deposited with the state treasurer for
4-3 credit to the motor vehicle
fund and allocated to the department to defray
4-4 the costs of duplicating the
plates and manufacturing the decals.
4-5 5. As used in this section:
4-6 (a) “Duplicate number plate” means a license plate or a set of
license
4-7 plates issued to a
registered owner which repeat the code of a plate or set of
4-8 plates previously issued to
the owner to maintain his registration using the
4-9 same code.
4-10 (b) “Substitute number plate” means a license plate or a set of
license
4-11 plates issued in place of a
previously issued and unexpired plate or set of
4-12 plates. The plate or set of
plates does not repeat the code of the previously
4-13 issued plate or set.
4-14 Sec. 4. On or before October 1, 2005, the department of motor
4-15 vehicles and public safety
shall determine and publicly declare the number
4-16 of applications it has
received for the issuance of license plates pursuant to
4-17 section 1 of this act.
4-18 Sec. 5. The amendatory provisions of this act expire by limitation on
4-19 October 1, 2005, if on that
date the department of motor vehicles and
4-20 public safety has received
fewer than 250 applications for the issuance of
4-21 license plates pursuant to
section 1 of this act.
