AN ACT relating to state financial administration; revising the provisions governing the distribution of federal money received by this state from the lease of federal lands; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 328.450 is hereby amended to read as follows:

1-2    328.450  1.  [The state treasurer shall deposit in the state distributive

1-3  school account in the state general fund money received in each fiscal year

1-4  pursuant to 30 U.S.C. § 191 in an amount not to exceed $7,000,000.

1-5    2.  Any amount of money] Money received in a fiscal year by the state

1-6  treasurer pursuant to 30 U.S.C. § 191 [in excess of $7,000,000] must be

1-7  deposited in the account for revenue from the lease of federal lands, which

1-8  is hereby created.

1-9    [3.] The interest and income earned on the money in the account, after

1-10  deducting any applicable charges, must be credited to the account.

1-11    2.  The state controller shall, on a quarterly basis, ascertain from

1-12  reports received by the state treasurer the portion of money in the

1-13  account for revenue from the lease of federal lands attributable to the

1-14  extraction of fuels, minerals and geothermal resources in a county and

1-15  apportion the money attributable to that county as follows:

1-16    (a) Seventy-five percent to the county; and

1-17    (b) Twenty-five percent to the school district in that county.

1-18    3.  Money apportioned to a county pursuant to this section must be:

1-19    (a) Deposited by the county treasurer in a special revenue fund; and

1-20    (b) Used, at the direction of the board of county commissioners of the

1-21  county, for:


2-1       (1) Construction and maintenance of public facilities;

2-2       (2) Public services; and

2-3       (3) Planning.

2-4    4.  The state controller shall deposit, at the direction of the board of

2-5  trustees of a school district, the money apportioned to the school district

2-6  pursuant to this section in:

2-7    (a) The fund for the construction of capital projects established by the

2-8  board of trustees of the school district pursuant to NRS 354.6113;

2-9    (b) The fund for capital projects established by the board of trustees of

2-10  the school district pursuant to NRS 387.328; or

2-11    (c) Both funds specified in paragraphs (a) and (b).

2-12    Sec. 2.  NRS 328.460 and 328.470 are hereby repealed.

2-13    Sec. 3.  This act becomes effective on July 1, 2001.

 

 

2-14  TEXT OF REPEALED SECTIONS

 

 

2-15    328.460 Account for revenue from lease of federal lands:

2-16   Apportionment of money by state controller.  The state controller shall

2-17   apportion money in the account for revenue from the lease of federal lands

2-18   as follows:

2-19    1.  Twenty-five percent to the state distributive school account in the

2-20   state general fund.

2-21    2.  Seventy-five percent to the counties from which the fuels, minerals

2-22   and geothermal resources are extracted. Of the amount received by each

2-23   county, one-fourth must be distributed to the school district in that county.

2-24    328.470  Account for revenue from lease of federal lands: Money

2-25   payable to counties.

2-26    1.  The state controller shall ascertain from the reports received by the

2-27   state treasurer the portion of money in the account for revenue from the

2-28   lease of federal lands attributable to activities in each county and apportion

2-29   the money payable to counties accordingly.

2-30    2.  All money received:

2-31    (a) By the county treasurer pursuant to this section must be deposited in

2-32   the general fund of the county or the county school district fund, as the

2-33   case may be; and

2-34    (b) By a county or school district must be used for:

2-35      (1) Construction and maintenance of roads and other public facilities;

2-36      (2) Public services; and

2-37       (3) Planning.
