AN ACT relating to the transportation of pupils; requiring the boards of trustees of certain school districts to provide transportation for elementary school pupils who reside a certain distance from school; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 392.300 is hereby amended to read as follows:

1-2    392.300  1.  As provided in this Title, the board of trustees of any

1-3  school district may , subject to the requirements of subsection 2, furnish

1-4  transportation for all resident children of school age in the school district

1-5  attending a public school, including pupils assigned to special schools or

1-6  programs pursuant to NRS 388.440 to 388.520, inclusive:

1-7    (a) Who are not excused from school attendance by the provisions of

1-8  this Title; and

1-9    (b) Who reside within the school district at such a distance from the

1-10  school as to make transportation necessary and desirable.

1-11    2.  [When] If the board of trustees of a school district in a county

1-12  whose population is 100,000 or more furnishes transportation pursuant

1-13  to subsection 1, the board of trustees shall provide transportation for all

1-14  the pupils attending public elementary schools within the school district


2-1  who reside 1.5 miles or more from their school of attendance. This

2-2  subsection does not prohibit the board of trustees from providing

2-3  transportation for pupils who reside less than 1.5 miles from their school

2-4  of attendance.

2-5    3.  If the board of trustees of a school district in a county whose

2-6  population is less than 100,000 furnishes transportation for pupils attending

2-7  public schools pursuant to subsection 1, the board of trustees may also

2-8  provide transportation for all resident children of school age in the school

2-9  district attending private schools not operated for profit, over bus routes

2-10  established for pupils attending public schools. If such transportation is

2-11  provided, the pupils attending such private schools must be transported, if

2-12  space is available, to and from the points on the established routes nearest

2-13  to the schools which they attend.

2-14    [3.] 4.  The board of trustees of any school district may:

2-15    (a) Establish bus routes.

2-16    (b) Make regulations governing the conduct of pupils while being

2-17  transported.

2-18    (c) For the safety of pupils being transported, govern the conduct of

2-19  drivers by making and enforcing regulations not inconsistent with

2-20  regulations of the state board [of education] or with law.

2-21    Sec. 2.  The provisions of subsection 1 of NRS 354.599 do not apply

2-22  to any additional expenses of a local government that are related to the

2-23  provisions of this act.

2-24    Sec. 3.  This act becomes effective on July 1, 2001.
