AN ACT relating to crimes; prohibiting a business from employing, using or allowing a person who is less than 21 years of age to distribute promotional materials that include an offer for alcoholic beverages; providing a penalty; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 202 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  Except as otherwise provided in subsection 2, it is unlawful for a

1-4  person to employ, allow or use a person who is less than 21 years of age

1-5  to distribute promotional materials that include an offer for alcoholic

1-6  beverages for a business, including, without limitation, a gaming

1-7  establishment, a saloon, a resort or a restaurant.

1-8    2.  This section does not prohibit the employment of a person who is

1-9  less than 21 years of age to distribute a publication that includes an

1-10  advertisement for the sale of alcoholic beverages which is incident to the

1-11  publication.

1-12    3.  A person who violates subsection 1 is guilty of a misdemeanor.

1-13    Sec. 2.  NRS 202.015 is hereby amended to read as follows:

1-14    202.015  For the purposes of NRS 202.020 to 202.065, inclusive, and

1-15  section 1 of this act, “alcoholic beverage” means:


2-1    1.  Beer, ale, porter, stout and other similar fermented beverages,

2-2  including sake and similar products, of any name or description containing

2-3  one-half of 1 percent or more alcohol by volume, brewed or produced from

2-4  malt, wholly or in part, or from any substitute therefor.

2-5    2.  Any beverage obtained by the fermentation of the natural content of

2-6  fruits or other agricultural products containing sugar, of not less than one-

2-7  half of 1 percent of alcohol by volume.

2-8    3.  Any distilled spirits commonly referred to as ethyl alcohol, ethanol

2-9  or spirits of wine in any form, including all dilutions and mixtures thereof

2-10  from whatever process produced.

2-11    Sec. 3.  The amendatory provisions of this act do not apply to offenses

2-12  committed before October 1, 2001.
