AN ACT relating to local governments; expanding the authority of the board of county commissioners of a county to abate nuisances, dangerous structures and dangerous conditions; authorizing the recovery of any applicable costs for the relocation of tenants incurred by the county in abating certain conditions; providing that a board of county commissioners may levy a special assessment to collect costs incurred by the county in abating certain conditions instead of imposing a lien; authorizing a board of county commissioners to adopt certain housing codes; expanding the authority of the governing body of certain cities to abate certain types of nuisances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 244 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  If a board of county commissioners determines that a nuisance or

1-4  other condition described in NRS 244.3601, 244.3603 or 244.3605

1-5  requires the relocation of tenants, the board may arrange for the

1-6  relocation of the tenants and may, in accordance with subsection 2,

1-7  recover the cost of such relocation from the person determined by the

1-8  board to be primarily responsible for creating the nuisance or other

1-9  condition that required the relocation of the tenants.


2-1    2.  Before a board of county commissioners recovers from a person

2-2  the cost of relocating tenants, the board shall:

2-3    (a) Send notice, by certified mail, return receipt requested, to the

2-4  person from whom the board seeks to recover the cost of the relocation,

2-5  setting forth the date by which the person must remit payment to the

2-6  county; and

2-7    (b) Afford the person from whom the board seeks to recover the cost

2-8  of the relocation an opportunity for a hearing before the designee of the

2-9  board and an appeal of that decision to the board.

2-10  The date specified in the notice by which the person must remit payment

2-11  to the county is tolled for the period during which the person requests a

2-12  hearing and receives a decision.

2-13    3.  If a person appeals the decision of the designee to the board as

2-14  described in paragraph (b) of subsection 2 and is aggrieved by the

2-15  determination of the board, the person may, within 30 days after the

2-16  making of the determination, appeal to the district court of the county. A

2-17  judicial review authorized pursuant to this subsection must be limited to

2-18  whether the determination was arbitrary, capricious or otherwise

2-19  characterized by an abuse of discretion and must be conducted in

2-20  accordance with the procedures set forth in chapter 233B of NRS for

2-21  reviewing a final decision of an agency.

2-22    Sec. 2.  NRS 244.3601 is hereby amended to read as follows:

2-23    244.3601  1.  Notwithstanding the abatement procedures set forth in

2-24  NRS 244.360, a board of county commissioners may, by ordinance,

2-25  provide for a reasonable means to secure a dangerous structure or condition

2-26  that [is determined to be an imminent danger to the surrounding

2-27  neighborhood by] at least three persons [appointed by the board] who

2-28  enforce building codes, housing codes, zoning ordinances or local health

2-29  regulations, or who are members of a local law enforcement agency or fire

2-30  department [.] determine in a signed, written statement to be an imminent

2-31  danger to the surrounding neighborhood. The owner of the property on

2-32  which the structure or condition is located must be given reasonable

2-33  written notice [at least 72 hours] that is:

2-34    (a) If practicable, hand-delivered or sent prepaid by United States

2-35  mail to the owner of the property; or

2-36    (b) Posted on the property,

2-37  before the structure or condition is so secured. The notice must state

2-38  clearly that the owner of the property may challenge the action to secure

2-39  the structure or condition and must provide a telephone number and

2-40  address at which the owner may obtain additional information.

2-41    2.  The costs of securing the structure or condition may be made a

2-42  special assessment against the real property on which the structure or

2-43  condition is located and may be collected pursuant to the provisions set

2-44  forth in subsection 4 of NRS 244.360.

2-45    3.  As used in this section, “imminent danger” means the existence of

2-46  any structure or condition that could reasonably be expected to cause injury

2-47  or endanger the safety or health of [the] :

2-48    (a) The occupants, if any, of the real property on which the structure

2-49  or condition is located; or


3-1    (b) The general public.

3-2    Sec. 3.  NRS 244.3603 is hereby amended to read as follows:

3-3    244.3603  1.  Each board of county commissioners may, by ordinance,

3-4  to protect the public health, safety and welfare of the residents of the

3-5  county, adopt procedures pursuant to which the district attorney may file an

3-6  action in a court of competent jurisdiction to:

3-7    (a) Seek the abatement of a chronic nuisance that is located or occurring

3-8  within the unincorporated area of the county;

3-9    (b) If applicable, seek the closure of the property where the chronic

3-10  nuisance is located or occurring; and

3-11    (c) If applicable, seek penalties against the owner of the property within

3-12  the unincorporated area of the county and any other appropriate relief.

3-13    2.  An ordinance adopted pursuant to subsection 1 must:

3-14    (a) Contain procedures pursuant to which the owner of the property is:

3-15      (1) Sent a notice, by certified mail, return receipt requested, by the

3-16  sheriff or other person authorized to issue a citation of the existence on his

3-17  property of [two or more] nuisance activities and the date by which he

3-18  must abate the condition to prevent the matter from being submitted to the

3-19  district attorney for legal action; and

3-20      (2) Afforded an opportunity for a hearing before a court of competent

3-21  jurisdiction.

3-22    (b) Provide that the date specified in the notice by which the owner

3-23  must abate the condition is tolled for the period during which the owner

3-24  requests a hearing and receives a decision.

3-25    (c) Provide the manner in which the county will recover money

3-26  expended [for labor and materials used] to abate the condition on the

3-27  propertyif the owner fails to abate the condition.

3-28    3.  If the court finds that a chronic nuisance exists and [emergency]

3-29  action is necessary to avoid [immediate] serious threat to the public

3-30  welfare or the safety [,] or health of the occupants of the property, the

3-31  court [shall] may order the county to secure and close the property [for a

3-32  period not to exceed 1 year or] until the nuisance is abated [, whichever

3-33  occurs first,] and may:

3-34    (a) Impose a civil penalty of not more than $500 per day for each day

3-35  that the condition was not abated after the date specified in the notice by

3-36  which the owner was required to abate the condition;

3-37    (b) Order the owner to pay the county for the cost incurred by the

3-38  county in abating the condition; and

3-39    (c) Order any other appropriate relief.

3-40    4.  In addition to any other reasonable means authorized by the court

3-41  for the recovery of money expended by the county to abate the chronic

3-42  nuisance, the board may [provide that] make the expense [is a lien upon] a

3-43  special assessment against the property upon which [such a] the chronic

3-44  nuisance is located or occurring. The [lien must be perfected by:

3-45    (a) Mailing by certified mail a notice of the lien, separately prepared for

3-46  each lot affected, addressed to the last known owner of the property at his

3-47  last known address, as determined by the real property assessment roll in

3-48  the county in which the property is located; and


4-1    (b) Filing with the county recorder of the county in which the property

4-2  is located, a statement of the amount due and unpaid and describing the

4-3  property subject to the lien.]special assessment may be collected pursuant

4-4  to the provisions set forth in subsection 4 of NRS 244.360.

4-5    5.  As used in this section:

4-6    (a) A “chronic nuisance” exists:

4-7       (1) When three or more nuisance activities exist or have occurred

4-8  during any [30-day] 90-day period on the property;

4-9       (2) When a person associated with the property has engaged in three

4-10  or more nuisance activities during any [30-day] 90-day period on the

4-11  property or within 100 feet of the property;

4-12      (3) When the property has been the subject of a search warrant based

4-13  on probable cause of continuous or repeated violations of chapter 459 of

4-14  NRS; or

4-15      (4) When a building or place is used for the purpose of unlawfully

4-16  selling, serving, storing, keeping, manufacturing, using or giving away a

4-17  controlled substance, immediate precursor as defined in NRS 453.086 or

4-18  controlled substance analog as defined in NRS 453.043.

4-19    (b) “Nuisance activity” means:

4-20      (1) Criminal activity;

4-21      (2) The presence of debris, litter, garbage, rubble, abandoned or junk

4-22  vehicles or junk appliances;

4-23      (3) Violations of building codes, housing codes or any other codes

4-24  regulating the health or safety of occupants of real property;

4-25      (4) Excessive noise and violations of curfew; or

4-26      [(4)] (5) Any other activity, behavior or conduct defined by the

4-27  board to constitute a public nuisance.

4-28    (c) “Person associated with the property” means [a] :

4-29      (1) The owner of the property;

4-30      (2) The manager or assistant manager of the property;

4-31      (3) The tenant of the property; or

4-32      (4) A person who, on the occasion of a nuisance activity, has:

4-33      [(1)](I) Entered, patronized or visited;

4-34      [(2)](II) Attempted to enter, patronize or visit; or

4-35      [(3)](III) Waited to enter, patronize or visit,

4-36  [a] the property or a person present on the property.

4-37    Sec. 4.  NRS 244.3605 is hereby amended to read as follows:

4-38    244.3605  1.  Notwithstanding the provisions of NRS 244.360 and

4-39  244.3601, the board of county commissioners of a county may adopt by

4-40  ordinance procedures pursuant to which the board or its designee may

4-41  order an owner of property within the county to:

4-42    (a) Repair, safeguard or [demolish] eliminate a dangerous structure [;]

4-43  or condition;

4-44    (b) Clear debris, rubbish and refuse which is not subject to the

4-45  provisions of chapter 459 of NRS; or

4-46    (c) Clear weeds and noxious plant growth,

4-47  to protect the public health, safety and welfare of the residents of the

4-48  county.

 


5-1    2.  An ordinance adopted pursuant to subsection 1 must:

5-2    (a) Contain procedures pursuant to which the owner of the property is:

5-3       (1) Sent notice, by certified mail, return receipt requested, of the

5-4  existence on his property of a condition set forth in subsection 1 and the

5-5  date by which he must abate the condition; and

5-6       (2) Afforded an opportunity for a hearing before the designee of the

5-7  board and an appeal of that decision to the board.

5-8    (b) Provide that the date specified in the notice by which the owner

5-9  must abate the condition is tolled for the period during which the owner

5-10  requests a hearing and receives a decision.

5-11    (c) Provide the manner in which the county will recover money

5-12  expended [for labor and materials used] to abate the condition on the

5-13  property if the owner fails to abate the condition.

5-14    (d) Provide for civil penalties for each day that the owner did not abate

5-15  the condition after the date specified in the notice by which the owner was

5-16  required to abate the condition.

5-17    3.  The board or its designee may direct the county to abate the

5-18  condition on the property and may recover the amount expended by the

5-19  county for labor and materials used to abate the condition if:

5-20    (a) The owner has not requested a hearing within the time prescribed in

5-21  the ordinance adopted pursuant to subsection 1 and has failed to abate the

5-22  condition on his property within the period specified in the notice ; [.]

5-23    (b) After a hearing in which the owner did not prevail, the owner has

5-24  not filed an appeal within the time prescribed in the ordinance adopted

5-25  pursuant to subsection 1 and has failed to abate the condition within the

5-26  period specified in the order [.]; or

5-27    (c) The board has denied the appeal of the owner and the owner has

5-28  failed to abate the condition within the period specified in the order.

5-29    4.  In addition to any other reasonable means of recovering money

5-30  expended by the county to abate the condition, the board may [provide

5-31  that] make the expense [is a lien upon] a special assessment against the

5-32  property upon which [such a] the condition is located. The [lien must be

5-33  perfected by:

5-34    (a) Mailing by certified mail a notice of the lien, separately prepared for

5-35  each lot affected, addressed to the last known owner of the property at his

5-36  last known address, as determined by the real property assessment roll in

5-37  the county in which the property is located; and

5-38    (b) Filing with the county recorder of the county in which the property

5-39  is located, a statement of the amount due and unpaid and describing the

5-40  property subject to the lien.]special assessment may be collected pursuant

5-41  to the provisions set forth in subsection 4 of NRS 244.360.

5-42    5.  As used in this section, “dangerous structure or condition” means

5-43  a structure or condition that may cause injury to or endanger the health,

5-44  life, property or safety of the general public or the occupants, if any, of

5-45  the real property on which the structure or condition is located. The term

5-46  includes, without limitation, a structure or condition that:

5-47    (a) Does not meet the requirements of a code or regulation adopted

5-48  pursuant to NRS 244.3675 with respect to minimum levels of health or

5-49  safety; or


6-1    (b) Violates an ordinance, rule or regulation regulating health and

6-2  safety enacted, adopted or passed by the board of county commissioners

6-3  of a county, the violation of which is designated as a nuisance in the

6-4  ordinance, rule or regulation.

6-5    Sec. 5.  NRS 244.3675 is hereby amended to read as follows:

6-6    244.3675  Subject to the limitations [contained] set forth in NRS

6-7  244.368, 278.580, 278.582 and 444.340 to 444.430, inclusive, the boards

6-8  of county commissioners within their respective counties may:

6-9    1.  Regulate all matters relating to the construction, maintenance and

6-10  safety of buildings, structures and property within the county.

6-11    2.  Adopt any building, electrical, housing, plumbing or safety code

6-12  necessary to carry out the provisions of this section and establish such fees

6-13  as may be necessary. Except as otherwise provided in NRS 278.580, these

6-14  fees do not apply to the State of Nevada, the University and Community

6-15  College System of Nevada or any school district.

6-16    Sec. 6.  Chapter 268 of NRS is hereby amended by adding thereto a

6-17  new section to read as follows:

6-18    1.  The governing body of each city which is located in a county

6-19  whose population is 100,000 or more may, by ordinance, to protect the

6-20  public health, safety and welfare of the residents of the city, adopt

6-21  procedures pursuant to which the city attorney may file an action in a

6-22  court of competent jurisdiction to seek:

6-23    (a) The abatement of an abandoned nuisance that is located or

6-24  occurring within the city;

6-25    (b) The repair, safeguarding or demolition of any structure or

6-26  property where an abandoned nuisance is located or occurring within the

6-27  city;

6-28    (c) Authorization for the city to take the actions described in

6-29  paragraphs (a) and (b);

6-30    (d) Civil penalties against an owner of any structure or property

6-31  where an abandoned nuisance is located or occurring within the city;

6-32  and

6-33    (e) Any other appropriate relief.

6-34    2.  An ordinance adopted pursuant to subsection 1 must:

6-35    (a) Contain procedures pursuant to which the owner of the property

6-36  is:

6-37      (1) Sent notice, by certified mail, return receipt requested, by a

6-38  person authorized by the city to issue a citation of the existence on his

6-39  property of three or more abandoned nuisance activities and the date by

6-40  which he must abate the abandoned nuisance to prevent the matter from

6-41  being submitted to the city attorney for legal action; and

6-42      (2) Afforded an opportunity for a hearing before a court of

6-43  competent jurisdiction.

6-44    (b) Provide that the date specified in the notice by which the owner

6-45  must abate the abandoned nuisance is tolled for the period during which

6-46  the owner requests a hearing and receives a decision.

6-47    (c) Provide the manner in which the city will, if the owner fails to

6-48  abate the abandoned nuisance, recover money expended for labor and

6-49  materials used to:


7-1       (1) Abate the abandoned nuisance on the property; or

7-2       (2) If applicable, repair, safeguard or demolish a structure or

7-3  property where the abandoned nuisance is located or occurring.

7-4    3.  If the court finds that an abandoned nuisance exists, the court

7-5  shall order the owner of the property to abate the abandoned nuisance or

7-6  repair, safeguard or demolish any structure or property where the

7-7  abandoned nuisance is located or occurring, and may:

7-8    (a) If applicable, order the owner of the property to pay reasonable

7-9  expenses for the relocation of any tenants who occupy the property

7-10  legally and who are affected by the abandoned nuisance;

7-11    (b) If the owner of the property fails to comply with the order:

7-12      (1) Direct the city to abate the abandoned nuisance or repair,

7-13  safeguard or demolish any structure or property where the abandoned

7-14  nuisance is located or occurring; and

7-15      (2) Order the owner of the property to pay the city for the cost

7-16  incurred by the city in taking the actions described in subparagraph (1);

7-17  and

7-18    (c) Order any other appropriate relief.

7-19    4.  In addition to any other reasonable means authorized by the court

7-20  for the recovery of money expended by the city to abate the abandoned

7-21  nuisance, the governing body of the city may provide that the expense is

7-22  a lien upon the property upon which such an abandoned nuisance is

7-23  located or occurring. The lien must be perfected by:

7-24    (a) Mailing by certified mail a notice of the lien, separately prepared

7-25  for each lot affected, addressed to the last known owner of the property at

7-26  his last known address, as determined by the real property assessment

7-27  roll in the county in which the property is located; and

7-28    (b) Filing with the county recorder of the county in which the property

7-29  is located, a statement of the amount due and unpaid and describing the

7-30  property subject to the lien.

7-31    5.  As used in this section:

7-32    (a) An “abandoned nuisance” exists on any property where a building

7-33  or other structure is located on the property, the property is located in a

7-34  city that is in a county whose population is 100,000 or more, the property

7-35  has been vacant or substantially vacant for 2 years or more and:

7-36      (1) Three or more abandoned nuisance activities exist or have

7-37  occurred on the property during any 12-month period; or

7-38      (2) A person associated with the property has caused or engaged in

7-39  three or more abandoned nuisance activities during any 12-month period

7-40  on the property or within 100 feet of the property.

7-41    (b) “Abandoned nuisance activity” means:

7-42      (1) Instances of unlawful breaking and entering or occupancy by

7-43  unauthorized persons;

7-44      (2) The presence of graffiti, debris, litter, garbage, rubble,

7-45  abandoned materials, inoperable vehicles or junk appliances;

7-46      (3) The presence of unsanitary conditions or hazardous materials;

7-47      (4) The lack of adequate lighting, fencing or security;

7-48      (5) Indicia of the presence or activities of gangs;

7-49      (6) Environmental hazards;


8-1       (7) Violations of city codes, ordinances or other adopted policy; or

8-2       (8) Any other activity, behavior, conduct or condition defined by the

8-3  governing body of the city to constitute a threat to the health, safety or

8-4  welfare of the residents of or visitors to the city.

8-5    (c) “Person associated with the property” means a person who, on the

8-6  occasion of an abandoned nuisance activity, has:

8-7       (1) Entered, patronized or visited;

8-8       (2) Attempted to enter, patronize or visit; or

8-9       (3) Waited to enter, patronize or visit,

8-10  a property or a person present on the property.
